Default L1 to H4

My husband has been working in US for the last 3 years on L1 and currently has gone for an L1 extension. His visa and I 94 has expired on 21st August 2011. He has got an RFE on 22nd August 2011.Since I am on H1 B, we E Filed for H4 on 19th August 2011(without submitting the Supporting document). Though his company proceeded with answering the RFE, we are not sure if he can continue on L1 since we have already e filed for H4. Is he eligible to work in US after efiling for H4? If so, how long?

I was in a similar situation, but attorney said, as per my attorney whichever comes out last will be your effective status.
You can check with your attorney
