Priority dates transfers and Post 140-approval options Discussion related to transferring priority date of old green card file to a new file after 140 approval.

Default EB 1 EA rejection? What are my options?

I had applied for EB1 under EA category/ OR category - My background is clinical research in surgery. I had 13 letters. International.

After premium filing ,My aplication generated RFE. Surprisingly they rejected my respone within 20 hours and almost copy pasted RFE into final rejection. I fulfilled 2 /10 instead of 3/10 requirements.

My lawyer gave me 3 options -
File another EB-1 petition with other USCIS center in the country.
File a NIW petition which means a 4-5 year wait for my country of birth - india
File a petition against the rejection.

My present H1-B is valid till next year. Do I need fresh letters and what is my best option?

What are your credentials?
What do you think about your petition letter and reference letters?
Do you think your lawyer did a good job?
Some of my fiends who filed their EB1A case again with a different lawyer got their cases approved with similar credentials.
You may want to get a second opinion from another lawyer about your case.
