Sept 18th Rally: Car-pooling, Group Reservations for Air travel, hotel etc. This forums is for threads that are pertinent to Sept 18th rally. Default EB-3-I Darkness at the mid of the tunnell

EB-3-I is stuck in 01...not likely to move till Oct and then in OCT08..it will move by couple three months for the next 12 months till OCT 09..What are the option for EB-3 stuck here..from 01, 02, 03 ....

1) Convert to EB-2 ?.

2) wait for legislation from Logfren to pass

3) wait another 3 years...already in the Queue from 01..


If I choose to convert to EB-2..I have to put in a PERM and then I-140..what is the time line for getting my LC thro PERM and then my I-140 in EB2 cleared?? based on the current processing times..

Do I wait to see if Logfren's legislation goes thro ..if doesnt go with the conversion to EB-2...???

Please help me decide...

What you could possibly see at end-of-tunnel are:

Lofgren bill passing before election and recaptured numbers becoming available from 10/2008. All categories may become current and remain current for 6 months to a year.

OR

EB3 ROW becoming current atleast by end of next fiscal year (by 09/2009, so that EB3 I would start progressing at a faster rate.

OR

you (and everyone in EB3 I) would be asking the same question even after 3-4 years.

Oh well, Happy July 4th!!

If you can convert to EB2 ( eligible for it ) and recapture your earlier PD of EB3 then it would be the best course of action . If you keep on waiting for the bills to pass ( and they don't since this is an election year ) then you would just lose time.

I know we are all frustrated because of this seemingly endless wait but I am positive - it is not endless . It will end one way or the other - for some sooner and for others later.

OK if I go the convert to Eb2 route..when do Ihave to shift to the new employer..after the new PERM is approved or after the I-14o is approved??.

after 140 is approved!! Only then can u port your PD. Otherwise you will start at the end of line again....

What if previous employer withdraws approved I140 after changing jobs? In my case it has been more than 180 days after approval of 140/485. Is the PD still portable?

So I have to join the new employer only after the new I-140 is approved right..my current I-140 is already approved..

You can move to a new employer and start EB-2 (PERM based LC, I-140 etc.) with them. You can still retain the old PD because your I-140 has been approved.

My EB-3 labor PD is 02/2007, my I-140 is stuck-up in NSC for more than one year now.

Considering the present trend, I decided to move on to EB-2. I pressurized my employer to file for another PERM for EB-2 which they are now reluctantly doing. Let me see what happens

If I have to apply for a new PERM Lc and then I-140 in EB2..how long would the entire process take

PERM-How many months??.
I-140- How mnay months??..(10th year of h1b can I get Premium Processing) done

Its nice to see EB2 I moving forward...but will this fail the recapture bill for retrogressed countries?

what is the position for EB3 ?I know it must have become a dumb question but would like to know any help for us?
