Default layoff and what to collect from company

Hi Guys,

For those getting laid off in this tuff economy..waht is that we should collect from the employer..

1) Pay stubs - all to be safe..
2) Any letter...
3) Copies of all Immigration petitions receipts.. Originals of some .

Can gurus elaborate and add more ..

The most important thing if you are planning to use AC21 after layoff is make sure you take the RIF notification letter. THis is an official letter notifying you about the reduction in force (RIF) in the organization. This may help you in case ur AOS gets denied for some stupid reason like u should not have left your employer on own. This may prove to be helpful that you were laid off.

you need atleast the following:

1. All the paystubs
2. EVL (Employment verification letter) indicating start date, end date, annual pay (or pay rate)
3. Reference letter from your employer (if you can get that)
4. All immigration related papers (some photocopies like i-140. I-120's, LCs etc and originals like i-797's etc)

1. All the paystubs

6. Ensure Medical Insurance Coverage through spouse (if working) or buy independently for family until you find another job..


Guys please keep adding, this recession looming will cause more damage than previously thought.

If I-140 is approved and your I-485 is pending for more than 180 days, you can use AC21. You don't need RIF letter or anything. But, when you apply for citizenship, RIF letter might come in handy (if at all there is any question about working for sponsoring employer). IMHO, Its good to have.

Well, yes. It is true that you can use AC 21 if I-140 is approved and I-485 is pending for > 180 days. But, if I-140 is revoked, now-a-days, USCIS is declining the I-485 application. That is why I am afraid. My company has been revoking I-140s for all that are being let go. In this situation will RIF letter help ?

Hence teh need for RIF letter...u can even use news reports....but ensure that RIF letter has ur name as part of those layoffs...

Also I want to discuss what documents to sign at the layoff meeting with HR...do we just comply with whatever they want us to sign in order to get severance pay...
