Default Traveling with AP - Documents Needed

Friends, I'm traveling to India soon and have a valid AP. My 140 is approved by 485 has been pending. Here are my questions:

1. I'm going to carry a copy of my 485 receipt and140 approval notice; original degree certificates, prior H-1B approval notices, job offer letter, pay stubs, company badge and of course my passport. Do I need any other documents?

2. While coming back to the US, do immigration officials in India create any issues with AP (since it's a piece of document vs. a stamp in the passport) or they are aware of it?

While coming back on AP you will need only the following.
APs in original
I-485 and I-140 receipt notices
Letter of continued employment from your employer.
Recent paystubs

As for Indian emigration officers, they are well aware of AP. You won't have any issues with them.

If one has used AC-21 and now working on EAD and with a totally different employer, then is the letter from the new employer good enough.

I will really appreciate if you can let me know.

Also, when you reach USA, does that cause a big issue.

I am not in an AC21 scenario. When you are at the POE, you just have to give your passport, AP docs and I-485 notice to the officer. You don't have to give anything else unless asked for. All other docs are for backup in case ...

I traveled twice on AP. I was never asked any question. IO stamped my AP and I-94 and gave it back to me without any questions.

Traveling on AP is much easier than going for a visa stamping.

You are good with all those documents. But the required ones are AP and your Passport. They have your I-485, I-140 information on their system. It's only for our own satisfaction that we carry the copy of I-485, and I-140 docs.
However, its a good idea to have all the copies with you...but never give out preemptively to the VO.

What was your expiration date for AOS on I-94? Is it 1 year from the date of entry or till the expiration of AP/

I have changed my employer. and planning to travel on AP- how does that works ?What do I need from my new employer ? I will appriciate your input.

I-94 expiration date when entering on AP is 1 year from date of entry ( not the expiry date of AP)

Default is it advisable to traval on AP if one does not have a current job

i am in a situation where my current company might shut down. I have been part of recent layoffs.
I have covered the requirements of 485 application + 6 months and 140 has been approved over a year. H1 has not expired and i had been working with current employer on EAD for lats 9-10 months.

Is it ok to travel with a job/paystubs.

please advise.

I travelled on AP Nov 29th and the Io at POE kept one copy of my AP and asked to surrender the other copy when I leave teh US again next time. I believe that is the norm...however some ppl have argued that IOs need only collect the copy of AP and the original. The IO did not agree to that..and I oblidged..as I do not see any furthrer travel outside US until my AP gets renewed in Feb 2009. But in case someone has to travel and one AP copy is collected by USCIS on ur last trip and u have to surrender ur second orig AP to airline while leave out of US for a second trip..does that mean u can effectively only travel once on the AP doc valid for 1 year...!!????

Didn't you receive I-94 card at the POE (US) with authorized period of stay? (please confirm).

I understand that you submitted one of the two copies of your AP to the IO and the second copy was returned to you. Also, the IO suggested that you need to submit the second AP when you leave US next time.

I am not sure if you need to surrender AP when you leave US. I believe, AP is only for you to enter US. You should surrender the I-94 card before you depart from US.

Gurus - please shed some light.

It was either a miscommunication or the IO was extraordinarily clueless. You do not submit your AP to the airline. What you do need to submit is your I-94 card. The next time you reenter, they will not ask you to relinquish your only remaining copy of the AP and you can keep using it till it expires.

I wend to India and returned back to USA using AP in Feb 08. I gave only passport and AP at POE as well as at Delhi airport. No question was asked. Travel using AP was cool.

Does the IO at POE keep one copy of the AP with him/her OR give back both the copies after stamping?

I am traveling on AP next week to Mumbai.
