My employer has done nothing bad on me so leaving it for personal gain is somewhat selfish. I am planning to stay for more than 360 days before I port to a greener pasture. I want to leave the company in good terms so that I prevent problems in the future.

Anyway, I am getting salary according to LC and being allowed to go on part-time in another company.

Guys,

My PD is April 21, 2004. EB2 India.

My I-485 and I-140 has a Receipt date of Aug 17th and Notice Date of October 4th.

I work for a fortune 10 company. I was thinking of changing location within the company(for e.g moving from my current location to Bay Area), however the Immigration firm that the company employs says that I can move only after my I-140 is approved. I thought the Yates memo said that you can move if your I-140 is "approvable".

Please advise.

Please DONOT post something you are not sureof.Just to know the ETA number doesnot mean that you need to have the labor copy in hand and your post meant as if one cannot use AC21 at all if one does not have the labor copy..please people are already tensed due to this bloody shit called immigraiton!!!

While invoking AC21, does the new employment letter be the same as old letter or it should exactly match the LCA. Can somebody point out the exact thing that should be matched? Thanks.

It is not that simple as it looks like. I am not trying to scare and every case would be different and would not be like my case. As I am getting some tough time with old employer, other than that things are ok. You can actually request ETA 9089(if you filed labor in PERM) from DOL and you can get details like job title and job description.

I'm porting jobs next week using AC 21. I paid all the attorney's fees for my own GC, and so (fortunately) I have full access to all my docs that were filed for PERM, I-140, and I-485. My job description isn't *exactly* the same (old job was team lead, new job is manager), however my O*NET code is the same and so my attorneys advise that porting under AC21 should not be a problem. Furthermore, attorneys advised that I should not pro actively send in an AC21 notification, I should send that in only in response to an RFE.

i consulted with couple attorney and they advised not to send AC-21 documented to CIS until a RFE is generated - which is same your attorney advised as well.

Currently out of job

Thinking to move to EAD with same employer since what i heard is in EAD we don't need paycheck or out of job for 2 -3 months

I h1-B we need paychecks generated

Is it true?
