Default Work permit Expiring..New one coming ,could i work?

Here is my situation and I have a couple of questions:

I got my 485 application going and transfered employers after 180 days. My I140 was not yet approved...is that a problem?


I have had my work permit through the I485 application and it expires 9/15/07. I reapplied to renew it and Ive had already done the fingerprinting for it. My question is could I still work while waiting on the new card or do I need to wait ?

if you dont get the EAD before expiry then you cannot work. You need to have authorization on time.

the only risk changing jobs befor I-140 approval is that the employer can still revoke it.

but im just waiting on the card. doesnt having my biometrics done mean its approved?

if I understand correctly you have an EAD that's expiring and you are waiting for the next one right. If 90 days have past since you applied for extension just go to you local USCIS office through infopass and they'll make a quick phone call and issue an EAD then and there. Even without it you can continue to work for 240 days.

it hasnt been 90 days since i applied so i cant do infro pass. but you are saying i could still work for 240 after my current one expires if i dont have the new one?

You cannot work until you have physical posession of valid EAD. Not even a single day.
