I had an august 2004 labor that USCIS erroneously predatd on my 2006 August I-140. A couple of years ago when 2004 Aug was current, I followed up and was then told that I should never have been given the 2004 date as no I-140 was filed for it..and told, So, sorry about it...but please keep waiting for the priority date.

a USCIS mistake that they corrected after 2 years ....lots of frustration for me....

thanks guys,

I phoned my attorney asking how I can verify if this update was / was not a glitch and according to him my PD should be current for September. WTF
(perhaps he has an inside person somewhere in State Department).
I also called the service center and IO confirmed it is either approval or green card itself. Since I was updating mailing address as well, we will see how long it takes for approval to reach me.

My attorney said I can do nothing (at the moment) but wait for approval as it should list Priority Date and category as well and only then can we formulate appropriate approach for rescinding / reinstatiting AOS. I have put H1B on hold as well till we get a clear answer.
what a mess...

On a side note, wife had a dream where my GC arrived nice and shiny and it was approved in an EB2 category
Weird, since I dont think I have EB2 case pending anywhere... Unless my previous employer filed I-140 under EB2...

Will update again...

One more in same boat here .. EB3 India approval email received.. Dependent not approved , RFE for photos on EAD application .. EAD expires in one month ... lot of frustrations and trouble on my way I guess!!!!

and the story unfolds....

I got biometrics notice for an appointment in the past

So, I made copies of the notice and put together cover leter and asked to be rescheduled for Sep.

Will call next week to follow up. In the meantime I noticed soft LUD on the date of my supposed biometrics....but the online message still says document production ordered....

Total chaos guys....

PD 1/03
I140 approved - march, 2006.
485 status - Rotting in NSC with a single RFE
Lost H1, working on EAD. Invoked AC21 twice.
Attended DC Rally and contributed to IV many times.
Renewed EAD 3 times and AP 4 times
Total cost from the H1 days (new h1, extension, ead, ap, 140, 485 etc - $22000)
Total cost if I had bought a labor certification those days and having a GC by now - $15000
Not knowing if GC is this worth - Priceless.
R2I'd in Feb 2011.

I am EB3 ROW..
I guess, in the vast scheme of things, getting biometrics (even with past appointment date) is much better than having to battle the .."GC approved when PD is not current"..situation.

at least, company's att sent h1B under premium processing. If all goes well I plan to come back before they re-schedule biometrics...

I got the approved mail today, even though my PD is May 12, 2006 and the current bulletin date is two months behind. I hope this was not a USCIS mistake. My category is EB2 I, center Nebraska, Notice date Aug 17, 2007.

congrats on ur approval.
I saw couple of guys posting that they are getting approval emails even though their PD is not current.
what this means, is USCIS trying to clear backlog soon?

Though I haven't been able to get proper info from INS, I believe my approval is legit. I have had an EB2 I-140 approved in 2006 from a different employer. The GC approval notice shows the PD of 2002 (EB3 PD) and category of E26 (which I have learned EB2).

It looks my case is considered as 2002 EB2 , if I ever knew this I could have tried to get an approval earlier.

we see more and more cases where some smart USCIS system auto porting the applications to EB2 /earlier PD if one have different I140 approved. Another example is for an IV member texanmom .

Emails and online statuses were the standard Welcome Notice.

"we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days "

another email

"we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS"

The statuses went back and forth a couple of times between "Decision" , "Post Decition" and "Card production"
