Default marrying a US citizen while there's pending I-140 petition

I would like to seek advise regarding my case. I'm a Filipino citizen and I applied for Employment-Based Immigrant Visa ( I-140 ). My employer is about to file the I-140 petition. I am about to marry my US citizen fiance here in the Philippines next year. Could he file Spouse Visa ( I-130 ) petition in behalf of me so we could be together after our marriage even if I have a pending I-140 petition?
