Default Enter on AP with H stamp on passport

If i enter using AP while having a valid H stamp on passport what is my status ? The I-94 says AOS with validity of 1 yr but then can i continue to use H to change employers ?

Iam going to do the same and my Attorney said I will be on H until I switch to EAD.

What is the reasoning behind entering on AP when you have a H1 ?

To avoid stamping headaches and waiting for Stamped passport..Heard that the delay is now abt a month to get the Passport back because of PIMS validation.

That is a valid reason but when the poster said he has H1 stamped on passport that means he has H1 visa stamp on his passport

My experience: This time during my india trip we went to Mumbai to get H-1B stamped for my wife, did that, spent two days for stamping and spen few hundread dollars for air fare, hotel etc. Myself and my wife has EAD and AP. My H-1B six years has been expired. While coming back at Honolulu immigration, Officer made my wife to use her AP though she had her H-1b stamped.

Post same here

the officer did not see visa on passport and redirected to another floor for entry through AP. i think its your choice to use H or AP and one should stress on H if asked to use AP since H is safer.

I have H approval from another employer before entering on AP. I have'nt joined the new company yet. Would i need to go out and come back with H status or can i join the new employer as is.

If you read other threads on AP, it is discussed there, that showing both will only cause confusion and delays for you at POE. From other threads it seems it is advisable to show only either but not both. If you have stamped on the PP then use that if you do not then use AP.

In my case, the officer made me use my AP . Saying " AP is much more important than your H1b visa"

You are right. I have both but, I showed only my H1B visa at the POE.

So what is the bottom line??

Which is better/safer/advisable...whether to show only H1-B Visa on PP or AP at POE??

It is best to use H1, my wife came back from India in Dec07 she has AP but got her h1 stamped, our lawyer asked her to show just the h1.
