I'm planning to travel to India next month and would greatly appreciate your answers.
One of my friend recently travelled through Amsterdam and had no issues in using AP. He told me that he did not applied for a transit visa as there is no need and he also did not had a valid visa stamp at the time of travel.

Please check with your travel agent / airline / respective countries embassy from time to time as the rules may change.

Thanks

The validity was one year from the date of entry in my case.

No need to travel every year. If you renew your H1 with the I-140 approval, that will have 3 year validity and you can show that for all legal purposes like DMV, SSN, etc.

Your status is protected as 'Pending AOS' till a decision is taken on the I-485.

Thanks

You cannot renew your H1 after you use AP. With AP your I-94 status will be Parolee where as with with h1 your status is H1-B.

i am confused about which i-94 takes precedence, the one you get when you enter on AP or the one you get after you renew your h1b? will USCIS send the same i-94 with the i-797 as the one i use when i enter with AP?

If you do not have a valid US visa, despite travelling on parole document, you will need a europe country visa, even if you are just changing the airplanes. Its called the air transit visa. without which they may give you a hard time while boarding in india on your way back.

Default travel to India

Hey guys

My H1B is stamped till July 2008. I am a July 2nd filer for 485 and have Received my receipt notice for 485, EAD and AP.

I want to travel to India. Is having a H1B stamped safe enough or should I wait for the AP to arrive?

Thanks in advance for yor help

You can travel. No need to wait for AP with a valid visa.

Default You can still extend your H1 with travel on AP.

Yes you can. If you re-enter on AP and work for the original H1 petitioner from which one has a valid H1 approval (not visa), one can extend H1 at the time the original H1 expires and will then put back to H1 status.
