Default Bloodsuckers looming on my fate

My bloodsucking leach employer is holding back my I 140 and labor documents. Those abominable suckers are not providing even my 140 LIN number too. My case is getting handled by the company appointed lawyer who is licking my employer's feet.

I had got a pretty good offer with almost 50% rise but could not opt for it as a third party lawyer told me that it is risky to jump on EAD as i do not have these key documents. In case my I 140 gets revoked, I will not have enough proofs to support my MTR.

So here I am waiting in a dead end job, with my I 485 filed more than 400 days earlier and 2 years valid EAD and approved I 140.

I have applied for my documents from USCIS through FOIA recently.
Would like to know if anyone got their documents successfully by Using FOIA and how long did it take.

if your i-140 is approved and 6 months after that is over.. no employer can revoke your i-140. if your i-485 is filed and 6 months over then u r free to use ac-21. get in touch with the dept of labor and write a letter to them mentioning about this malpractice. if you r sure of ur new job offer... then hire an attorney to sue ur current employer to give u the i-140 approval notice. nobody will give you the original notice that will always remain with your employer but they should give you a copy.

not sure your case full details (like pd, category and country details etc), with what you have mentioned above, if i were in your shoes, i would not stick to your current employer. If you have the EAD , and have completed 180 days after filing 485, i would take the plunge to the new job. with the current retrogression, one never knows how long it will take for all of us to even come close to getting GC. all i am saying is, known devil is better than unknown god, if u know that u have good prospects, take up the job, deal with any RFE that comes up later. i am fearing that these employers are using the tactic of revoking 140 to threaten us these days. just like how they had our labor certification during those days, due to which we cannot change jobs. be your own judge. follow your instincts and do whats good for you. just wrote what i thought in mind..all the best.

485 status - Rotting in NSC with a single RFE
Lost H1, working on EAD. Invoked AC21 twice.
Attended DC Rally and contributed to IV many times.
Renewed EAD 3 times and AP 4 times
Total cost from the H1 days (new h1, extension, ead, ap, 140, 485 etc - $22000)
Total cost if I had bought a labor certification those days and having a GC by now - $15000
Not knowing if GC is this worth - Priceless.
R2I'd in Feb 2011.

I am waiting for the FOIA docs myself. I applied in Nov 2007. Mine was placed in a Complex track which will take like 2 years I think. According to reciept tracking I'm only half way through compared to the total number of requests. If you ask for a pirticular document, it will be placed in a simple one. If you ask multiple documents it will be placed in the complex track.
I heard the simple track takes like 6 months. Search on this forum, someone has posted about this earlier.

Got your advises. But you might have seen in many threads that even in case of straight forward AC21 ( ppl havinmg all docs) USCIS are sending 485 denial nowadays. And I have consulted 5 different independant lawyer in my case and each one of them said that employer can revoke any time they want. But even if they revoke it USCIS should send RFE/NOID to the benefitiary asking for proof of Ac21 usage. But due to recent retrogessions I guess USCIS is send direct denials.
I am at my 6 year H1B thus can't risk this. Because if i change job on EAD, i can't work till my case is reopened again.

For getting receipt number of your 140, call USCIS with a general question about your 485 (you atleast need 485 receipt number). Once they answer, ask them you also want to know the 140 receipt number associated with your 485. They should be able to tell you. If customer service not able to tell, try calling your service center using POJ method.

Is your company listed in the below link? If not add to it so that others are little careful in approaching such kind of blood sucking employers. This could be one way those blood suckers are exposed so that others won't fall into their prey.

My sister's employer is a desi consulting and not willing to provide a copy of approved I-797. No that anyone has not heard of. Wanted to know how did you approach in receiving approved I-797 document on your own.

take an infopass and ask the IO. Tell him u want to change the employer. You can give the A# and they should be able to give the I40 number

Alternately, I think you can also file form I824 to request a copy for an approved petition. There is a fee and processing is delayed at least 7-8 months usually. Check the documentation for that or talk to a lawyer.

Your employer filed for GC for you why do you call him blood sucker? Believe me, folks - desi companies will do everything possible in this world to keep you locked to their company. They speak very sweet - they make u feel like they are your elder brother - but they do it because you are billable and they want to keep you as long as they can.
140 is employer's document and they have no obligation to give you. Talk to a god lawyer and find out if a copy of 140 is really needed.

Why do you need 140 and labor document? It is not necessaryfor AC21. Just call your lawyer/employer, ask him what job classifcation they filed your 140. You dont need to know job duties/description. If you are in IT field, you can chage to any IT realted job which is similar to what you are doing now. It is very simple. By the way, how do you know your 140 is apporved, if you do not know the receipt number?
