Default Any body in this Situation ???H1Extension pening and applying 485

Any body who is in the above situation like H1b extension pening ( I -94 expired ) and applying for 485 ?

Any chances for 485 to get rejected as you are sending expired I 94 ?

My attoney said this is USICS problem as i applied before the Visa dates became current ?

Any advise appreciated

I am also in the same situation. Applied in March, My H1 expired in April. My attorney says I would maintain my STATUS until 240 days after applying for extension. That's about 8 months. Hope it will be approved in the mean time. So it shouldn't be a problem for 485 application. Lets keep updating this thread as and when we find any new info on such cases.

If you apply for Premium Processing, you will get your approval notice by July 1st week or 2nd week and you can still file for your GC with the new I-94.
The $1000 may be worth it if you want peace of mind.

I upgraded to PP lastweek .However i am still waiting for the approval .Attorney is busy and not responding ( have to change him for 485 as he increased the rate overnight)
.Is the case status online is real time ?Also how many days will it take receive the copy of the approval.

My H-1B is about to expire in Oct. 2007 and my employer was going to file for 7th year extension in July. What happens now? Which one should be filed first - H1B extension or I-485 or it doesn't matter?

You have sufficient time ....Apply 485 and wait for the EAD until sep ( if you want to convert to EAD) else go for the filing of the ext .....
