USCIS also accepts a affidavit given by parents instead of a birth certificate get a affidavit from your parent that you were born in Vellore TN, this should get you through.

Just pay and get it done. My brother did the same because there was flood where the local office was located and all the documents got destroyed there was no way to verify it, paid 500 bucks and got it done. Simple Just get hold of a lawyer and ur problem is solved.

He is now enjoying his PR status...........

No problem is big in life, just think ...........................................

Default Birth place correction

I have exactly the same situation.

Only way to get this resolved is to get it corrected in passport. For that, you need to get a court order from india and then send your passport to local passport office in US along with court order and they will correct it on passport.

You can direclty call indian passport office in US and they will explain you the process. I did the same.

Will a birth certificate from Indian embassy in DC work in such a case?? The embassy does issue birth certificates on the basis of a passport?

get your correct dob cert and then get an endorsement in your passport with the current state. Providea letter during the first submission of your corrected dob for future applications where you have used the old dob. Do not falsify information on your immigration forms.

I have heard that for I-485, birth certificate issue date must be close to actual date of birth, as per Baker Law. Otherwise, additional affidavits must be needed. Is this true? I saw it only on Baker Law. Other law firm websites do not mention of any such requirement.

Birth must be recorded as close as the actual date of birth - typically within one year of birth. What this means is that the Registrar of Births (or whatever is the government body that records births and issues birth certificates) must make a note in their system the date you were born at a date that is as close as possible to the actual date of birth. The birth certificate itself can be issued at any time. For example, if you lose your birth certificate due to theft or fire or something else, you can still apply for a new one. The new new birth certificate will have a recorded date and an issue date.
However, I do not know if this practise is followed in all countries. I know that it is followed in the US becasue I had to get a birth certificate for my daughter who was born here. And it had both the "issue date" and the "recorded date" on the birth certificate.

so, during I-485, will affidavit be needed to explain why issue date is not close to date of birth? That is what Baker law website claims.

I am in same situation. I got these from consulate, but my lawyer suggested to get non-availability of DOB from municipality office in India and two affidavit from relatives.

My suggestion is to have them rather then relying on letter issued by Indian consulate. I am saying this as DOB letter which I got from consulates state "As per passport .."

For my wife we have affidavits from her Sister, Brother, Mother and Father, these affidavits are signed in Jan 2003. Would they work now? or do we need to get new affidavits for her?
