Default PD Porting - Help Requested !!!

Hi Gurus,

I have a EB3 I-140 with a approved date of May 2007. I had applied for a new PERM and got my labor approved in EB2 category and will be applying for my new I-140.

I have the following questions:

1) At what stage of should I be applying for my PD transfer for my new I 140? And what is the procedure for the same?

2) I am in the state of VA and can any of you suggest any attorney who can successfully help me in PD transfer. And any clue about what would be the fees the attorney would charge for the 140 alone.

3) I am a July 2007 filer and applied my 485 also, for my EB3 and should I be applying for new 485 (when the priority date becomes current for the new EB2 ) ? Or while at the time of porting can I ask USCIS to use the same 485 which I previously applied.

In my opinion, you do not need to do anything. just go ahead and apply for I140. In your I140 application make sure you use A# from your approved EAD. That way this new I140 will get in to one file with I485. When they approve EB2 I140 you will get notice with old EB3 PD on it. At least that's the case with me. Fortunately my old PD was current at the time of I140 approval so they went ahead and approved I485 too. I didn't send any communication to link PDs, yet. Of course it's safe to have good attorney too . Good luck.

Any idea about the attorney question? And clues about fees for 140 application?

Hello Gurus,

Do you have any idea how much would Sheila Murthy or Rajiv Khanna would charge for applying 140 alone and successfully port the PD from my EB3 to EB2?
