Default URGENT: H4 is expired; Need to apply for F1 before getting the H4 extension

My H4 is expired two days back. Even though I have already submitted application for H4 extension, I have not even got the receipt number. Can I apply for my H4 to F1 transfer when my H4 is expired? Or do I need to wait till I get my H4 extension? Please let me know.

First of all, Is it legal to stay in US when my H4 is expired and H4 extension application is still in process? Please let me know.

As long as you have applied for your H4 extension and your spouse's visa is valid, you should be ok. However, I am not sure about transferring to F1 while your H4 is not current.

Kanmani,

If your papers reached USCIS Service center before your expiry of H4 you are good. The receipt notice might take some time to arrive but the Received date at Service center is more important. If you mailed it through FEDEX, check the date when they were received by USCIS.
