Default Can her husband block her approved green card?

A friend of mine is a citizen from a non Visa-waiver country, married to an American. They've been married for two years and she is expected to receive her green card in a few months at the embassy of her country of origin where she still lives. Because of abuse issues, she wants to separate asap but is afraid he might retaliate by trying to prevent her from receiving her green card. Is that possible, or should she wait until she has the Green Card in her hands? Thanks!

It will be much easier to separate after GC is in hand. It's possible to get separated before and still get GC, but she would need to file additional paperwork. Consulting with an attorney is recommended.

Remember in a marriage case....it is a 2 step process...Initially they get a temporary Gc and then after 2 years they get a permanent GC. So, she needs to see which GC is she getting before making any decisions.

Also ask them to go for counselling....if they can reconcile...

it seems that they are already married for 2 yrs....In that case she would get 10 yr GC.... The best scenario is that she should wait till she gets the card and then take whatever action she wishes to take
