Default Mrs. Murthy Advise: Travel While in H1B status and Pending I-485

Guys,

I came across this info on Murthy.com website.

I read in this forum(immigrationvoice) that we can re-enter using Advance Parole(AP) and continue work for the same Employer who is holding the H1B without any issues.

Mrs. Murthy talks about potential problems and seeking an attorney advise before travelling (and re-enter US using AP).

I appreciate if you can share your experience if you used AP to re-enter into US and continue working for the same employer.

I am planning to visit India and use AP to re-enter and continue working for the same employer.

Want to know others experiences who did the same.

i wouldnt be too surprised if these lawyers start a program similar to insurance. a "AP travel insurance". buy it for $250 per person & if you have any trouble entering with AP they would come out & help you.

Lof of people doing this and no issues with it you can use AP and continue on your H1 with the same employer..Go a head and enjoy your trip..

It was also mentioned travel with AP and continue work on H1 and filing extensions should be OK...

From Murthy's website I understand this

If you travel on AP, you are paroled in. Unexpired h1b would allow us to work for the same employer but will not grant us any status. The status is changed to "Paroled In" AOS candidate (although there is no such term). Until any amendment or extension on h1b is applied and approved, one does not have nonimmigrant status due to paroled in I-94. In case 485 is denied in the interim, one is doomed with no status to go back to.
