Default Need guidance

I am on my 9th year extension of my H1B. I have to leave to my home country at a short notice. I have H1B stamped on my passport. However it expires at the end of September. I may not be back until the first week of September.

I have already filed for my H1B extension and I am waiting for my Receipt notice.

Will there be any issue coming back into US when my visa stamped on my passport is valid for less than a month. I don't think my extension will be processed by then.

Anyone on this forum who has had similar experience in the past?

Default it is not the visa, but the i-94

you can enter the country even a day before your visa expires, but the main thing here is the i-94 stamp where the immigration officer puts the duration of your stay...it will be till your visa expiry date. so it is better for you to have an approval for the extension so that you can get to stay till the expiry of your visa. do premium processing or something, you still have time...

i am not an attorney...check this out with your attorney...

Since I have already filed my petition, can I change this to Premium Processing from regular processing?

Yes, you definitely can change it to premium processing.
talk to your attorney / Company HR.
