my h1 was extended last year sometimes during april i think ( i had approved i-140 that time itself), waited for freakin 1 1/2 years to even file 485. it was filed and approved in california and got 3 years extn.

485 status - Rotting in NSC with a single RFE
Lost H1, working on EAD. Invoked AC21 twice.
Attended DC Rally and contributed to IV many times.
Renewed EAD 3 times and AP 4 times
Total cost from the H1 days (new h1, extension, ead, ap, 140, 485 etc - $22000)
Total cost if I had bought a labor certification those days and having a GC by now - $15000
Not knowing if GC is this worth - Priceless.
R2I'd in Feb 2011.

First off - Congratulations to the OP. Isn't it a massive relief?!

Secondly, I have to reiterate what Paskal mentions.
All countries are retrogressed.

It bears repeating again, and this time in red. All countries are retrogressed

Cases like this highlight the complete unpredictability in the system. Part of the problem we, as an organization, are working to solve.

EB3 ROW PD is back to 2002, as mentioned in this thread, however this case (like my own) highlights that you don't have to have PD current at time of GC approval. What makes this extra surprising is that this is a JULY filer (I was June).

It goes to show that Name Check can happen speedily (and refer to other postings for recent updates on this front)

Just to let you know there are EB3 ROW still waiting. My priority date is November 2002 and applied for AOS in May. No rhyme or reason to this process it would seem.

Cannot imagine I am the only old PD still waiting while people who applied four years later get their green cards.

And also from my experience --- You got to keep poking the USCIS authorities for them to wake up and take your application to process.

Let me tell you my story:

My company applied for my extension after 1st 3 yrs of H1 last year in Sept. I expected to get extension before Nov and I had planned to go to India in December. Well the dec came and I did not have extension, but I went to India as I was supposed to hoping that the extension would just arrive. Dec over, Jan over, Feb over, I am sitting Idle at home in India. Then I called USCIS- the officer told that since I left the country while extension applied and my h1 has expired, it means I have abondoned my application.. What the f***. Well, later I started following up with my h1 company.
Finally my office Amin staff personally went into USCIS office, explaining my situation and also showing proof that the client is waiting for me to get back and start work, I got h1 extension approved on Jul 24th.. What a relief.

Ran to Chennai for stamping and flew into Bay Area. Next day Med appointments cause i was to file 485 before Aug 17th.
Oh Gosh! I could barely do that and my application reached the NSC on Aug 17th. Now got the receipt numbers.

So Unless you keep poking them You wont hear updates. Just my 2 points experience in the swarm of people here.

Did he have a aging out kid who filed for 485 along with him. I have heard thoses cases get prioritized.

In any case, I am happy for him.

I do know where I come from, I am from the UK. My screen name is Indiana as in the state where I live. I also know my own priority date. Since my PD only became current in May that was the earliest I could apply so my processing time is not unusual. The ones who are getting approved within three months are the unusual cases.

I know a EB2 India application (obviously not mine) that was approved after this July fiasco and no where I could find his PD date current in those previous months (except July where everyone was current). After this guy got his GC, I am convinced there is no "system" in place. It is all random and you can't really predict anything.

first of all congrats. but i have a question.

you said you are EB3 ROW (Bangladesh) but you applied your I-485 on June 29, 2007 with a Priority Date of Feb 06.

But on June 2007 (just before the VB fiasco) the Visa Bulletin for EB3 ROW was caught up to June 05 (http://travel.state.gov/visa/frvi/bu...etin_3236.html). But your EB3 ROW PD is Feb 06. So how is that possible?

Only EB2 ROW is current. Are you sure you are not EB2? You can confirm this by looking at your 140 notice. Otherwise you must have sent out your application June 29 (Fri) in the hope of reaching USCIS by July 1 or 2 (Sun or Mon). That's the only way I could make sense of this.

Either way man, your stars must all lined up or something man. You are indeed very lucky.

the reason I am pestering you is becoz I too am EB3 ROW with PD of Mar 06 and I filed on Aug with an approved 140. I am now kicking myself for not mailing out June 29 Fri.
