Default Things to do after EAD

Questions after receving EAD card (Any valuable information is appreciated)

Scenario A:

Spouse on H4, received EAD cards (not working yet and not intended to work for six more months)

1. Can we apply for SSN, if yes where?

2. Do we need to inform IRS about spouse SSN (Immediately or later while filing taxes)

3. What about ITIN, do we need to inform IRS, when, where and how? Guru's please provide your suggestion

4. EAD received but no notice about FP, Guru's please advice

Guru's any more value information or suggestion is appreciated. Please guide

Yes. Print out forms at
http://www.ssa.gov/
Then find out your local office and take application there with you.

If you have SSN there is no need for ITIN. ITIN is just to claim tax benefit.

Don't sweat it. Just wait till tax time and whoever you go to for tax purposes will take care of it for you. I am sure it is a simple form that you fill out.

I read in one of the forum in IV that we need to contact IRS after receiving SSN, so trying to be bit cautious.

Read ITIN number letter issued, it has directions on how to cancel ITIN and send copy of SSN to the IRS address listed. This is important for them to update records. They normally don't acknowledge

Please keep copies of any correspondence with IRS. Finally when you file taxes, file with SSN and copy of ITIN letter. That way you are making sure that the new SSN corresponds to the old ITIN on which taxes were filed before.

Yes, you need to call to IRS and speak with Account Setup to change the ITIN previously used to file taxes to the new SSN.

Thanks for all your info,

I read the ITIN letter from IRS, it stated that we need to send a copy of SSN along with ITIN letter to the address mention on it or contact the local IRS office.

Yes you can. Go to local Social security office with your EAD, passport, and/or DL; they will process your SSN in max 14 days approximately.

If you are on H1, you should have your SSN by now and if you are on H4 and just got your EAD or got approval notice (Which is EAD with card). You can go to SSN office (ssa office http://www.ssa.gov/)

--> then click on the link "complete an application" and print out the last page and fill it

As adviced by our friends, take Driver's Lic, EAD approval notice, your I 797A with/with out I 94 and Passport with/without I 94.

following questions i asked to my lawyer. hope they r helpfull to all of u.

1) Should EAD card receipt make any difference to H4 visa

interview

as well as re-entry in USA?

SHOULDN'T MAKE A DIFFERENCE UNLESS SHE USES THE EAD CARD BEFORE SHE

LEAVES THE US. THEN SHE'S NOT IN H-4 STATUS ANY LONGER.


2) When should we expect AP? Has her AP application been filed

already?

HER AP APPLICATION WAS SUBMITTED CONCURRENTLY WITH THE I-485 AND EAD

APPLICATION. WE EMAILED YOU THE RECEIVE NOTICE. THESE APPLICATIONS

TYPICALLY TAKE 90 DAYS TO PROCESS, BUT BECAUSE OF THE LARGE AMOUNT OF

APPLICATIONS RECEIVED IN July AND August IT MY BE LONGER. YOU CAN CHECK

THE STATUS OF THE CASE ON LINE AT WWW.USCIS.GOV WITH HER RECEIPT NUMBER.


3) What is the procedure to activate her EAD? Does acceptance of a job

only activate it?

WHEN SHE ACCEPTS A JOB AND THEY TAKE A COPY OF THE EAD AND COMPLETE THE

I-9 FORM.


4) We are going to India to renew her(H4) and my(H1B) visa
So can she switch from H4 to EAD after coming

back from India in Dec with acceptance of a job?

SHE CAN SWITCH TO EAD AFTER RETURNING IN December. ONCE SHE USES THAT

EAD CARD THOUGH, SHE'S NOT IN H-4 STATUS AND ABSOLUTELY MUST HAVE AP

BEFORE LEAVING THE US FOR INTERNATIONAL TRAVEL.


5) Can she apply for SSN now before she leaves for India? Should

application to SSN make an adverse impact to H4, as she is planning to

enter USA on H4 itself?

SHE CAN APPLY FOR THE SSN BEFORE SHE LEAVES FOR INDIA. THERE SHOULD

NOT BE AN ADVERSE IMPACT ON THE H4 BECAUSE SHE HAS A SSN.


6) What's the procedure for switching back to H4 from EAD in case?

SHE WOULD NEED TO GO TO A US CONSULATE AND APPLY FOR THE H4 THERE WITH

YOUR H-1B APPROVAL AND MARRIAGE CERTIFICATE, ETC. THIS TYPICALLY CANNOT

BE DONE IN THE US BECAUSE ONCE SHE USES THE EAD/AP HER STATUS IS

"PENDING AOS" AND SHE CAN NOT CHANGE STATUS BACK TO H4 WITH AN I-539

FORM.


7) Should she carry EAD or finger printing notice with her during

outside USA travel?

IT MAY NOT HURT TO TAKE A COPY OF THE EAD CARD IF THERE IS A QUESTION

ABOUT IT, BUT IT MAY BE SAFER TO LEAVE THE CARD AT HOME. IT WOULDN'T

HURT TO TAKE COPIES OF THE RECEIPT NOTICES FOR BOTH YOU AND YOUR WIFE

Default Why and how H4 is cancelled after using EAD?

Hi
How does USCIS know that H4 dependent used EAD to take up a job. or do we need to inform USCIS that we are using EAD?. Is the I-9 form sent to USCIS?. IS there any official link from USCIS on any guidance on this?.
