Default Is there any rule for one PERM per person from the same company

Can someone help me?
Is that true that one PERM is allowed per person from the same company. I have approved perm with PD of 2003 eb3. My company is willing to reaply for me in eb2.
Thank you for your help. I had asked this question before but could not get the resource.

I came across some interesting Perm info today though

New Multiple PERM Filing Policy (AILA-DOL Liaison Minute)

* 1st Approved PERM and 2nd PERM filing for the same position: Automatically denied.
* 1st Approved PERM and 2nd PERM filing for the different position: Audit with request for return of the first application or an explanation of why there is a second application being filed and the first application cannot be returned.

PERM Processing Statistics (AILA-DOL Liaison Minute)

* Case Processing Statistics:
o Total Received since PERM started on March 28, 2006: 160,000
o Total Certified : 73%
o Total Certified During Period of 10/01/2005-10/01/2006: 80,000
o Total Denials: 24% of total applications received
* Processing Times:
o 48%: Within 30 days
o 20%: From 31 days to 60 days
o 24%: Denials
o 28%: Currently in Sponsorship and Analysts Review which were filed before 07/01/2006.

Wish they provide the same speed that is shown in PERM as well as in the I140 stage in the third stage, as well as for all those cases stagnant in the BEC.

Pappu,
Does it matter if the first approved labor is an RIR ? I am thinking of doing a second LC thru PERM. I am in 485 stage waiting with a PD of Feb 2003 based on a RIR for an EB3 position. Since then I have moved up and my position should be eligible for EB2 now. If we do apply for EB2, does this impact my earlier app ?

I will ask in next conference. Sounds it is too risky to do that because of audit process.

I am in this exact situation currently. EB-3 PERM approved Oct 2005, refiled as EB-2 in Aug 2006. Application still pending 4+ months now, have not received audit nor denial. Attorneys have sent a couple status requests into DoL but they just respond with unhelpful "application still pending".

Does somebody know that if the first labor was not applied through PERM process (normal legacy PRE-PERM processing under EB3) and 2nd labor is being applied through PERM process under EB2, is it going to create any problems like revoking of first labor? I would like to do this to port my earlier priority date in the 2nd labor. I already have I-140 approved from the first labor. Please suggest.
