Default H1-B Employee Relocation on Resignation

Is an employee who resigns entitled to relocation expenses like the employee who is laid off?

Relocation to india? then yes. Relocation to other places in US? then it's a no.

I would return home to Canada. I am not sure of the immigration policies in India

Could you point me to chapter and verse from some official DOL or USCIS website?

Default If the company processed your H1B

If the company has processed your H1-B and they have fired you. Probably you are entitled for return fare to your home country. Because somewhere under some clause of H1B application, company has to sign that they will give return ticket to employee when the work is done. Please do some home work. Go to USCIS site and look for details needed to file H1-B application. Or if you have your H1 paperwork, look into it. You will stumble on something.

Yes for H1B you are entitled to get Return ticket back to your home country if you are being laid off or fired. Last year my earlier employer offer me return ticket to home contry. They specified that we are offering as per the clause or law of H1B visa. Offcourse I didnt accept it but you cant get money for not accepting this return ticket offer.

only if termination is initiated by the employer, not employee. If you resign, the company is not required to provide you the one way ticket to your home country.
