Question Employer not giving I140 details

My employer is refusing to reveal any information in the I140 application.
I wanted to switch employers but I am afraid I will not have the relevant information for AC21.

I know I can petition USCIS under FOIA, but this takes 12-18 mths.

Is there any other way, I can obtain the details?

Any help appreciated.

Default You can do this....

Just keep these documents stacked up and send to USCIS when they will ask for AC21 proof , its not a requirement by USCIS to send AC21 declaration proactively. Dont send anything now.

#1) File the FOIA form and let it run for 18 months. Just keep a copy of the form that you filed and other filing proof.

#2) Hope you have at least copy of I-140 receipt notice. Keep that as well.

#3) From the Online approval page take a Print out that your I-140 number is showing approved and that number should
match with the one on Receipt Notice and FOIA application.

#4) One Simple english cover letter explaining why sending these 4 pages of Indirect Proof instead just giving 1 page
I-140 approval Notice ( bash your employer in this letter but don't go overboard , the purpose here is to file docs
AC21 and thereby getting rid of the employer forever - not to fight with employer)

I mean, i've planned to do this because my employer will not give 140 approval copy either.

Question

Thank you for that concise information.

But you still need the proper job code or atleast the right description of duties for the AC21.

How long will this employer make money out of me without giving me my proper due? (just whinning)

I wonder if there is another legal way to make such employers be more responsible ?

diptam's advice is pretty good.

if you have the stomach for it, get a lawyer and threaten to sue you employer.

Default Employer not providing job code

Good suggestion DIPTAM.

My employer is not providing me the job code. On request, my HR gave me the job code.

Later I verified with the flcdatacenter.com. I realised that there was no such code used for my priority date. My employer submitted many applications with same priority date. All the applications have same job code used (differenet from what was given to me). Later I approched the Head HR with multiple emails explaning them the situatuion. NO RESPONSE from them. HR is hiding from me without responding.

How do I get the correct job code from the employer? Any suggestions will be appreciated.

One does not need to have I-140 receipt number or approval copy as such. But definitely he is required to know the I-140 receipt number and he can show the CRIS approval information as part of the records.

One needs to know DOL job classification code, Job title, Job description and salary offered as approved PERM labor certification based on which his I-140 has been applied by his GC sponsoring employer.

Please engage a new attorney using form G-28 who inturn will take care of AC21, which has been advised as the best strategy by Murthy.

Will a new G-28 help in getting the job code from employer / previous attorney.

Can I change my old attorney (employers attorney) to new one without changing employer? How risky is it?

What is the the field that we can make out the job code from ?

I dont see any "job code" field on the Labour Cert

In the perm labor form 9089. check page 2 , Section F, you will find "SOC/O*NET(OES) code". That is the SOC or the job code . Also called Occupation code.

We dont fill the I-140 # in I-485. Employer / attorney attaches the document. If that was the case we wouldnt have to worry much.
