Default H1B filing - Master's degree not yet available

Hi,

I am a Master's student and I have been working with a company on CPT for 1 year. I am graduating in August 2011 and my degree will be available in September 2011.

The company I work with wants to file for my H1B but my degree and final transcripts are not yet available. The H1B quota for Masters is filling up fast this year and I would like to apply before it ends.

Can a letter from the school that I will be graduating in August 2011 suffice to apply for H1B under Masters quota or do I need to wait until I get my degree is received.

Please suggest what should I do.

You cannot file under the Masters quota unless you have the degree certificate in hand. Even a provisional degree certificate wont do. This is what I was told by the law firm. Since you are still on CPT you can go for OPT and your company can file for H-1B next April.

May be your employer doesnot understand OPT or is scared. In either case, talk to your company and explain them that you will continue the employment on OPT - which is 12 months (or) 29 months if your employer is e-verified.
Meanwhile you can save some $$ while you work on OPT.
