Default Experince count for Green Card Processing.

Hello there,
I worked with a company "ABC" as a consultant for one years then left that job and joined again as fulltime employee for "ABC" after three year.
Now "ABC" doing my GC , can I use my past experience as a consultant with ABC for GC filing.

Please help me.

Thanks

Default theoritically yes,, it counts

as per my knowledge GC rules stating that prior 5 years experience
1) you worked as a consultant to ABC company [here as per law employer is -- EMPLOYER1]
2) Joined as a full time employee in ABC [here as per law employer is ABC]

now filing GC through ABC,, it means,, you can count EMPLOYER1 experience...

NOTE: this is my guess I don't have any practical experience in this matter.. So always check with good attorney for full confirmation

Default

someone ask same question on lawyers calls to Ari and Greg and they said you cannot count the experience you got from the employer you worked with earlier.
Please re-confirm again on this.

good luck.

Default It counts

You can use the experience working as Consultant at Company ABC, if you can show that the roles and responsibilities differ by atleast 50% you can use that experience. Differ during the time you worked as a consultant and the time you worked as a full-time.

However you cannot use the experience working as full-time at ABC. My colleague had the same situation. This is just my experience and might not be 100% accurate.

Good luck.
