Default Good to carry documents for AP travelers

Hi,

What kind of questions should I be prepared for at POE by IO while traveling on AP? Also, what docs do you suggest as "Good to carry Documents" while working on EAD.

- All copies of AP
- EAD
- Passport, of course
- H-1B 797, if valid and if you wish to try entering on H1B
- 485 receipt notice (Good to carry)
- 140 approval notice (Good to carry)
- Labor approval notice (Good to carry)
- Company identification card/badge (Good to carry)
- Current employment verification letter (Good to carry, I never did and I was okay)
- Old stamped APs, if you have used AP to travel in the past (Good to carry)

It is highly unlikely that you will be asked to show any of the 'Good to carry' documents, I never was, but since there isn't a lot of extra 'good to carry' documents, I usually prefer to have all the listed ones with me.

Post my 2 cents

First time when i came from canada using AP I was struck for 4 hours in immigration. They will check your passport, AP and stamp your AP. The common questions asked are Is your job function same as per the petition. and who is your employer. then they will tell you to go.

The second time i landed at Atlanta the POE asked me why did you apply for a green card. The answer should be I like the country then he asked that means you don't like india. I told its not so and then i have to wait 1 hour for AP stamping after taking my baggage. they asked me the same above questions, who is your employer and what are your job functions.

Relax Don't worry too much. Its safe to carry all other documents but you may not need it.

Folks,
I entered Atl POE using AP(last sat), the IO was very courteous and asked why it was getting so late to get GC(million $ Q), I had just given I-94,customs form, 2 AP's and passport, he didnt ask for anything else.
Since it was my first time using AP, i was sent to secondary inspection room(which he had explained to be as a very basic stamping on my AP) i had to wait for about an hour, after which my passport,i-94 and both ap copies were returned, one of them had stamped as may-29-2010. I asked her is it valid till may-2010 even though the expiry date in the AP states jan-2010? she said yes and that i can use it for travel till may-2010.
Question is, has this happened to anyone else?
Overall it was a very smooth entry

Default EAD, AP and Passport

AP, EAD, Passport and Verification letter from company..Take some recent paystubs to prove your relation to the company. I was taken to the secondary verification room. I changed companies after 6 months on EAD. They asked how can you not work to the company that initiated your GC process. I have to explain them. These people dont know much about these 485, etc. Overall they looked at everything and stamped my AP.No need of other documents.

It's best to take a print of the Yates ac-21 memo, an employment letter from your new employer, any ac21 docs you filed and some recent paystubs.

Last Thursday, I came back from India at Chicago POE. There was a separate counter (no secondary check room) at Chicago. I just gave my Passport, AP (2 copies), filled in I-94 form and Customs form. Thst's it no questions asked.

I came through JFK two weeks back. I used AP and no questions were asked. The officer was confused that my AP was expiring in 2 weeks and I have not used it at all. In the secondary inspection, the officer could'nt understand that I have not received my green card yet since my 485 has been pending for 6 years now. I got to explain to him about the delay for EB3 I and visa numbers. Nothing else was asked.

Exclamation Can I use AP even when I am not on EAD with my employer?

Gurus,

I am currently with same employer who initiated my GC, and I was in the job till May 2009.
Currently I got EAD and AP but I am working with my company on H1. I'm planning to visit mother India and do not want to go for H1 stamping since I do not have another offer in my hand.

Please let me know

1) what needs to be done, before I leave USA?
2) After coming back to USA, do I need to work on EAD or can I work on same H1?
3) is it must to file AC 21 to use EAD and AP to get into USA?

I have seen in the above discussion about required document list...
