Default EB3 to EB2 Porting - Opinion / Advise please

All

My Priority Date is Nov 2002 - EB3 , need a quick advise from you folks. Would it be beneficial if I Start porting my Priority date to EB2 now ?

1) I work for a fairly big consulting company, which would not port my priority date to EB2
2) I would have to change Company (Risk) while i am on my 11th year of H1b, with 17 more months of my H1b still valid.
3) Will need to spend Time (Don't know if it may be equal to the time required for GC in EB3 with my PD) & money on this new application.

Thoughts please !

Thanks ...

I feel you should wait for couple of months. Given the rate at which dates are moving ahead, it can happen that your EB3 PD (Nov'02) is current by fiscal year end. Then all the $$ and time spent for porting would be useless. Check the prediction in each bulletin to get some idea. Also, maybe keep the docs ready for porting in case you don't any good results by sept'11.

You should start looking into it asap . Since there are less people before you and if you wait for year or so then it will not be useful. If you want do it now so you can get GC at 6 month ahead.

I recommend porting. EB3 is not like EB2. EB3 can move pretty slowly even though you seem to be pretty close. I know a person with a 2002 PD who started his porting process already.

When it comes to risk of changing jobs, it is not a big risk as you think. If you have been with a company for long, you "feel" secure. It is just a feeling, nothing more. Once you get your GC, you will have the real security. It is worth taking a short term risk for a long term security.

I am in the same boat.I would suggest to port to EB2 . I saw some one posting that 500 EB3 visas wasted last year , as you might be aware even if visa recapture is done. recaptured visas will never trickle down to EB3 queue.

I believe you should port on the regular course GC is 1.5 to 2 years away. With porting you should have your GC on hand in 6 months.

Wiat for this year end (Oct 2011) final cut off date for EB3 to be published. Once you know the cut off date you will be able to make a final decision since nothing will happen again for EB3 till 2012 Oct, so you will have 1 year time in which you know nothing will happen and you might as well as use this time for porting. Remember that no legislative mesaures will be passed to help EB3 number move till the election is over so you are looking at a minimum of 2013 for any relief.

Do not listen to anyone to wait.

Just port.

Porting is the best option and do is fast to get out of the wait period.

Default This is a double post from my end but may be worth it.

**** Its been 12 yrs , Finally I have ported after brief R2I and CMB2US *****

Dont lose "Hope". Its the most audacious word. I left the country in May 2009 with frustration , anger and the fact that whenever I was finding a contract in that tough times peoples were even NOT interviewing me the moment they heard that I'm a "H". They dont want to hear if I have EAD or my GC is going on - PERIOD. The vendors and contacts who loved me ( because they ripped high billing from me in 2000-2009) even started ignoring me.

I felt harassed that i'm fighting on a "non-level" playing field. Eventually I got something at CA (I live at MA) for 55/hour and on the other hand I got a top notch salary offer from a US born Hardware company's Offshore office at Bangalore, India. They SHIPPED all jobs from US to India. I took that offer because I have my Old parents there at India and missed their company for 9+ yrs ( apart from regular vacations).

However I could not adjust with several things there and ran back here after 10 months and found a truly EB2 job and ported my EB3 Mar 2005 Priority Date to EB2 in less than 1 year - I'm CURRENT ( YAAAYY !!) and Waiting for GC to come any day....

By the way - I'm not M.S from US or any kind of masters degree holder from anywhere. I have a strong B.E degree from one of the Top 10 engineering colleges of India (not I.I.T though) and 11+ yrs US experience and 12+ yrs total IT experience in my kitty.

Nothing is impossible - Wish Best of Luck to all EB3 India guys , you have the ability to turn the game , just play it truthfully and play it smart.

Let me know if anyone needs any help - Email me or PM me.

Regards,
Diptam

Default You are wrong buddy...

See my post above.

Why 2-3 years , I did successful porting in 8-9 months after a rough phase of 1 year of my life. Of course I've blown $'s like water in Premium processing Fees and Hiring Top Notch attorney's but I see that as a investment for getting 10 times return in 10 years.

Thanks,
Diptam

The buck never stops unless you want it to stop - stay positive

Default Good question...

I'll talk to you offline on this - long story.

Several factors come after you stay in a developed world for more than 9 years - Kids health , Work culture, Day 2 Day life , Weekend Life - I think I posted in IV about my experience and reasons to comeback. Check my Old thread posts...

Thanks,
Diptam
