Default EAD Usability

Hi friends,

I got my EAD last week even though I am not planning to use it. I have valid H1-B approval for 3 more years. But not stamped yet.

I recently visited DMV for a date of birth correction. But they requested me the INS documents.

Question

Is my H1B automatically void if I show my EAD as evidence instead of H1B (take time if I use H1B)? Or H1B gets void if I use EAD only for job purpose.

Only when EAD is used for job purposes it takes effect.

But why do you want to go back to DMV in a year. If you use EAD your DL will be extended for a year onlt till EAD expiry date.

Oh that's true. if I use H1B then i have to wait at least 3 months to get my new DMV card in the mean time they will take away my current dmv and give temp one (a piece of paper). I probably wait till I go out of the county so I can get my visa stamped. That way it is easy to get DMV card.

Question To be on H1 FULL TIME & USE EAD for a Part Time job

Dear All,

Is the above allowed...any link on the USCIS site?

Appreciate your inputs...I am on H1B with a Company and intend to do so for some time to come...can I utilize my EAD for a part time job?

Hello,

I am planning to use my EAD and go part time with my employer and part time (20 Hrs.) for my PhD assistantship. I have heard that the H1 will be invalidated in that case. I spoke with Rajiv Khanna and he said that part time in the same feild (PhD is in the same field) is a good case for proving intent but my concern is if H1 is invalidated then will I be out of status as soon as AOS is denied (if it is)?

But yes,once your I140 approved,if you have some reason to believe that you are short of some document for I485,then there is a need to stick to H1 but otherwise say BYE to the slavery.

meaning you can only have one job status H1B or EAD. once you start working employer ask you EAD Card copy or I-94 (H1B) copy. only one. so its your decision.

you are right,

hence always keep a current H1B in addition to I-485 based EAD

Sand_14,

My labor was done in record 6 days and I 140 was approved without a problem. There could still be an issue with 485? Also forgot to mention that I am current under EB2 ROW is there any chance that the GC will be approved before January -thus making me stay with the company full time for another 6 months?

Hmmm... all this is so frustrating - I am almost tempted to take the risk and finish that PhD (all but dissertation)

Everyone has a different version...once the 6 months are over, what are the implications? Why not use the EAD?

Default AP for Canada visit

Guys I am not changing jobs and does not have valid visa in my passport. To visit Canada can i use AP when coming back in, would that trigger my EAD use do I need to notify my employer about anything for this like I-9 form etc ....

Please do reply, appreciate your input .........
