April 2010 MTR approved.
Mar 2011 advertisements published for EB2 labor.
July 2011 EB2 labor filed.
Sept 2011 EB2 labor approved.
All at Texas service center: -
November 18, 2011 (Friday) 10 a.m. EB2 I140 received by USCIS
November 22 (Tuesday) 5 p.m. EB2 Labor approved. Old priority date May 2003successfully ported.
Decmber 1, 2011 Interfiling letter submitted for pending I485.
March 6 2012, First inquiry by senator on I485 status.
March 14 response from USCIS: - "I have requested the files be sent to an officer for review. Your constituent should receive notification in 30 days after we receive the files".
April 20 Follow up inquiry from Senator.
April 22 response from USCIS:- "The files are assigned to an officer. Your constituent should receive notification in 30 days."
May 1, 2012: - CPO mail.

I have donated, I don't how much but around $2000 to IV since 2006 and would continue my support in future.
My advice to all EB3-I folks: - Port to EB2.
Calling USCIS or the service requests don't help. Don't waste your time. Go to your congressional representitive.

My EB-2 , I-140 approved on May 2, 2012. Do you think , I should contact my local congress man office to initiate the status inquiry now or should I wait 3/4 weeks ? I already emailed to EBUpdate.tsc@dhs.gov and opened a Level 1 SR. I got the reply from e-mail that I posted in my earlier post.

Yes. Absolutely. Do contact your congressional rep. There is no harm whatsoever. You will know the exact position and it will only speed up things.

Default Cards received

Both me and my wife received our green cardsyesterday by priority mail yesterday. From May 1 to May 8 we received a total of 6 e-mails per case number from USCIS. What a unforgettable week in life!!!!!!!!! We waited for this moment for 9 years. It all seems just a flash now. It is now time to catch up with life and decide what to do next. And there is a lot to do, most of which was kept pending by us.
Following are the details of how we received e-mails
5/1 – CPO Mail
5/1 – CPO mail repeated just before midnight
5/1 – Approval Notice mailed midnight
5/4 – USPS picked up package containing new card
5/7 – We mailed you the new card
5/8 – USPS confirmed that the Card was delivered

Chapter closed.

Yes, contact the local congressman's office and seek help. Otherwise, no one knows when your application will be picked up for adjudication.

In our case, I have seen no movement and contacted the local congressman's office.
We have contacted on Friday and we got the approval email on Saturday (yes, on weekend).

How long did it exactly take for approval after the interfiling request submitted? We submitted our interfiling request on Nov 01, 2011 and still waiting. Priority date is Nov 2005. Little worried since it's taking so long.

After interfiling letter was sent by attorney, I opened SR for linking the files as my 485 was at Nebraska and new 140 was at Texas, files from Nebraska were sent to Texas.

Opened another SR to ensure that all the required files are available at Texas.

Contacted Congressmen and he followed up twice with Texas SS to ensure an officer has my files and he is actively working on it.

Second followup by Congressmen office insured that my case was being actively worked upon and I need to wait for 60 days before I see any progress on my case.

Last date of followup by congressmen was 8th March and on 8th May I got CPO mail. [60 days ]


After interfiling request you need to follow up your case with SR and congressmen so that atleast you know there is some movement in your case and it is being actively worked upon.

For me it was close to 6-7 months

Since my Eb-140 got approved on May 2, 2012, I was thinking that I should wait at least couple of weeks before initiating congressional inquiry. But it appears that I do not need to wait 3/4 weeks. I can ask congressman office to start the inquiry. Am I right ?

Do it now, either way you will need a day or 2 to provide all the details to the congressmen. before they call USCIS it will be atleast a week

My eb2 I140 approved 2/15 from TSC and my old I485 and old I140 are in NSC. I have sent interfile letter both to the address on 485 receipt and the other address found in forums. I sent interfiling email about 3-4 times so far. On 4/11 I got this response from nsc.ncscfollowup@dhs.gov for my interfiling email request:

"Good morning

Your files were requested and forwarded to a supervisor for review and assignment to an adjudication officer. We have no specific time frame as to how long this might take.

Please note that although the current visa bulletin indicates you are eligible to adjust based on the published priority dates, demand for EB2 numbers has increased dramatically during recent months, and at a much faster rate than had been expected based on the rapid forward movement of the cut-off date. Therefore, it has been necessary to retrogress the China/India EB2 category in an attempt to hold number use within the annual limit, and maintain availability for those countries which have not yet reached their per-country limit.
Unless there is a drastic change in the current rate of number use, EB2 numbers will not be available until October 1st, under the FY-2013 annual limit. Department of State is indicating that it will not be possible to speculate on the cut-off date which may apply at that time until sometime in late summer.
We are sorry for any inconvenience this may cause. The National Customer Service Center’s toll free number is 1-800-375-5283 or you may access the CIS website at USCIS Home Page should you have any further questions or need additional information

Also in March I opend SR about delayed processing, and got the response that because of pending caseload at NSC being high my case is getting delayed and I should hear back in 90 days. This was in march.

Prior to this, my local congress man contacted uscis around March 16th and got the response that I should wait 90 days. I asked my congressman again in April 1st week and he came back with a similar response that Eb2 I is unavailable for rest of year.

Please tell me what I am doing wrong, why my case is still pending even after all the above efforts.

Default Any LUD before Approval

I want to get rid of the application sataus checking in every 10 minutes. Did anybody who get the I-485 approval see any kind of LUD(soft or hard) before getting the CPO mail ?
