My PD will finally be current again in April :-)
Filed 485 in Jan 2004, did not get approved during the window in 2007, and finally seeing my PD current...
Two classmates who filed in EB3-I after me with PD later of mine are already citizens... just the luck of the draw I guess...

Guys the news of 18K additional numbers is official. This is not wastage of visa numbers in family based but a well established rule that numbers from certain FB categories spill over to EB. 10K EB visas spilled over previously as well in 2010.

All EB2-India folks hang in tight do not worry about intermediate visa bulletins till Jul or till whenever they decide to start spillover. Out of these 18K, 12K will be an extra to EB2 – I / C. Porting is at the same old level however what is happening is that EB2 was unavailable for 6 months last year so it created a backlog. Porting does not exceed 4K a year however as we had a 6 month blackout last year we can expect 6K this year. The monthly cap of 250 – 300 is not enough to satiate this hence no movement. Dates will definitely hit mid 2008 for sure even with the ever increasing inventory.

All EB3-I folks if your PD is anytime beyond Jan 2003 consider porting to get GC within a year’s time if there is no legislative change like HR-3012. Dec 2002 will be a very long month to go this is a very dense month.

Well, I guess entire 2003 until 2004 Dec is a dense period. It slightly eases off from Jan 2005.

Dec 2002 has a inventory of 867 this is more than 3 months of inventory so there will be a VB when there will be either 1 or no movement. Nov is less than this.

from Demand Data, ROW EB3 demand is ~4500 until Jan 1 2012.
4500 can be cleared in 3 to 4 months.


Once ROW gets cleared, there is small window of Opportunity for EB3 I spill over, during this window as ROW dates advances, there will be new EB3 ROW Applications.
It will take some time for these apps to get to approval state. During this time, EB3I start getting spill over from WW EB3 category, as it is most retrogressed country.


I am expecting more than 10K spill over to EB3. that will clear entire 2003 EB3I. by Summer Next year EB3 will in Feb- March of 2004 dates.

Once all the USCIS start processing newly filed ROW application EB3I movement slows down.

what i am trying to say is EB3I going to get spillover from WW EB3 category in 2013.

Is my reasoning make sense..

Hi Srinithati,

The '3550' number before Jan 1, 2012 only represents EB3 ROW demand prior to July 2007. Nobody from EB3 ROW has filed their 485's after the July fiasco. So, those remaining 2007, 2008, 2009, 2010, 2011 and 2012 numbers for EB3-ROW are not included in the demand data. So, your spillover over theory is probably not correct.

Based on these numbers the priority date movement of 1 week per month seems in order. However I wouldn't be surprised if the dates moved by 3 or more weeks next time around... this is USCIS for goodness sake :-D

better to live in real world ..
Demand data is a approximate data . and it depends on lot of factors .. how many AOS are filled,predictions ,historical assumptions ...................
there is no way that it will have spill overs from EB2 - EB3 this yr or next yr ..
check the pendig 485 report .. it will give you some more idea ..

Thanks Teddy.You give me some hope man.I missed the boat in 2011-2012 with PD of June 2007.Hope to get this year or next .
