Default attorneys - please help with travelling on AP

My current AP is expiring Dec 05.2009. I have a trip planned for India from Sep 27 to Nov 3. Is it ok if I return back on Nov 4 with my AP expiring on Dec 05, 2009. I have applied for AP renewal yesterday only - still waiting on receipt notice. I don't think I can get my AP renewal approved before Sep 27. Please advice - should I stick to my travel plan or wait until I get the renewal approved.

most probably, you will get your AP before sept 27 because couple of my friends who had applied last month got approved AP within a month time frame. YMMV.

now, if i were you, i would not have applied for new AP since you are coming back before the expiration of your current AP. this is what i did last year when i went to india. my AP was expiring in october, and i applied for new AP only after coming back in sept. anyway, the officer at SFO gave me I-94 for one year!

Even if you get the new Advance Parole approved, most likely it will be valid for travel after Dec 05.2009. So either way you need to use your existing parole. You can apply for a new parole and travel with the old parole before the new one is approved. All you have to ensure is that you exit and enter the country during the same parole's timeframe.

Default please check the instruction of form 131

Gurus,

I was just breshing the instructions of AP form 131 and found this in page 4,point D

If you travel before the advance parole document is issued, your application will be deemed abandoned if:

1. You depart the United states; or
2. The person seeking advance parole attempts to enter the united states before a decision is made on the application.

I have no idea how and where this apply, but just want to bring to your notice.

I have had a pending application and traveled in the past, also entered the US with the old parole with no problem.
