OK ..guys ..here is a catch ! Why USCIS / DOS are/have been lately adjudicating I-485s of EB2 ROW even their processing times were not 'Current'. - To get a better average I-485 process time. IF you have noticed, in any hearing or reports USCIS/DOS always use average processing days/time for any visas/forms.

Why this is hurting us ? - To get their performance report better, they have been issuing visas to people who have filed their I 485 before 2-3 month back. Actually, they are suppose to follow a processing time ( NSC/ TSC / V and C) and if cases are not eligible, they shouldn't approve it.

I brought this point long back...not sure any one understands it but we have lost 1000s of visas because just because they don't obey processing time. These all visas, since last 2 years would have been trickled to EB2/3 I/C and other countries.

IF you see MR Charles Opp. statement in Murthy.com, it says exactly the same. Of course, what it means for them is to save their &*&(& against any future congressionally inquiry.

As per MR C.O. - there are 20OK I-485 pending...$ 120K applications are from India....let's assume appications from China ( the great Chaina ! ) and Philli and Mexico combined would come around $ 30-40K . How many are left ?

Any way - who cares ?

This means they will soon run out of ROW applications and then will be forced to look at Retrogressed categories (they are receiving very few new applications)
IF USCIS processing times are honored..we would have seen huge numer of visas trickling to EB2 cate. this year and eventully making all EB2 'C' and helping EB3 next year !

Any way EB2 will see a storng movement early next year.

Default EAD and AP in One Card Valid for 2 Years

The peformance report says , in the next EAD renewal cycle, they would be able to combine the EAD and AP into one document, valid for two years.

They are doing this because they expect 2007 filers will have to wait for years before they get current.

This is a very difficult statement to make.

I am still not able to understand "heavy EB1 usage". If this is because of adjudication of old applications, then yes, next year we will see strong movement.

But if EB1 usage surge is due to too many EB1C filing, then this trend may continue and we may see nothing trickling down to EB2 and subsequently to EB3...

It would be interesting to see this data in their yearly statistics (when they come out in October!).

Until then, at least I can not predict anything...

How is it that some members here are predicting EB3I to be current in a year? USCUS has said it has 60K EB2I applications (same w/ EB3I), and that 3,200 visas were available in FY2009 for that category. It would take 19 years for the last applicant to get his GC by those estimates.
