Default H1B Visa extension and USCIS reply. URGENT!!!

This is my case; please help with your inputs;

I Came to US thru company A in Jan 2005, I Transferred to company B successfully in July 2005. New I-797 thru company B was valid till July 2008.

I visited India in May 2008, went to stamp the Visa in Mumbai thru company B and got a 221g query. The 221g query got cleared after 3 months in August 2008 but by that time my I-797 thru company B got expired. My H1B extension was filed by company B in Jan 2008 but they got an RFE in July 2008 and said they cant reply the RFE.

I approached another company C who said they are ready to transfer the extension (I have 3 years left in my H1B app.) for me. We have recently filed H1B application thru C for the extension of H1B under premium processing. Now USCIS is asking for I-94.I am in India since May 2008 and I have already given all my information to company C.

How can I Prove I am in India since last May 2008. I have given 221g pink skip I got here to my company C.

Anyone with similar experience, please share your thoughts. Any chances of things getting approved or passed.

If they need only I-94, the only possible option is to send copy of your last valid I-94 which you have surrendered when you left. You must have a copy of it. Send it.

OR ask the lawyer, what should be done in this case.

I am sorry but it seems a bit complicated. If you are in India you can't have any I-94. Last one you submitted and new you didn't have untill you are in US. I am sorry but it seems you have to file new H1B on April,09 with company C or any company.

Please talk to good attorney for advise.
