Default When can i start with new employer

Hi,

I am currently working for a consulting company (Company A). I got a full time offer from another company(Company B). I have decided to take that offer. My employer has filed my LCA and got approval and they are going to file my H1 this week. My question is when can i start working for Company B?? Can i start working after i receive the H1 receipt number or do i have to wait till i get the H1 approval??

Under AC 21 provisions, you can join Company B after filing the H-1B and having a receipt is a good proof of that. But I wouldn't advise joining the company unless the case is rock solid and there is absolutely no chance of denial. IF the case is really good, you can do a premium processing to get a faster result.

Thank you for the reply Raj. Up to my knowledge the case is rock solid. I am moving out of a consulting company to a good product based company. The product based company is the one who is filing my H1. And i was never on bench during my whole H1 tenure. I have all the pay stubs and other stuffs properly. My H1 have been successfully transferred couple of times before this. Do you still think i have to wait for the approval or can i start working with the receipt number??
