Default Moving to old employer.

Hello there,

I have an interesting scenario here. I did H1 transfer 6 months ago to new company and currently working for them. I have a labor approved from my previous employer and they are willing to take me back. I want to go back to them. Here is my concern.

Is my H1 B valid for the previous employer?

I would really appreciate if the experts can please respond to the question.

Yes you can move to old employer with out any problems as long as they have not withdrawn H1 sponsorship.

ok.
if old employer cancelled i129 petition and now willing continue 485 filling. He need transfer h1 back and continue 485 filling? (i140 was approved). Will there be any issue?

You need to transfer H1B back to previous employer. As soon as it is filed, you can start working for old employer. You are in a very good position. All the best

One more advise from the expert. Tina, you must put a disclaimer under you name that you are new to immigration law field.

For the guy who posted the question, please check with your old employer. He may not have revoked your H-1B.

They cancelled and I have a copy of the letter sent to uscis. Also got the confirmation from employer.
