Just called USCIS the lady said they are processing as per the date mentioned in their system, which is the NOTICE DATE and not the receipt date. Their system don't track receipt dates.

This is a deviation from what it has been usually published/stated. The notice date of July filers goes up to Oct/Nov.

It it is Notice Date, it is not a happy news for several Jul 2007 fisco EB2 filers.

By the way, any recent LUDs on I-145 with Receive Date between Aug 1 and Aug 10 of 2007.

Makes perfect sense to me...Even though majority of people here (including my lawyer) indicate it's based on RD, I totally believe it's Notice date.

different IO quote different things. On

it says, I quote, "The easiest way to monitor our processing time is on our website, where we post the filing dates of cases that we are now completing."


So the date is the filling date. Is filling date the same as RD or ND? need to google more.

Good Question and point of discussion.
The processing date of Jul 15 is Aug 10, 2007 (NSC). They might have been able to process some of the cases of Aug 10, 2007 on/before Jul 8, 2008. As we understand, there is no hard and fast rule and USCIS deviates significantly from published date (from case to case).

We have entered in discussion about whether RD or ND is used based on input from "SunnySurya". Basically my RD is Aug 2 and ND is Sep 17. If it is RD, my case is already included. If ND, it may be years away. I see no LUD.

Angry backward processing - 9th wonder of the world?

can some one correct me?

I remember TSC processing date as published on June 15, 2008 shows that they have processed cases till July 17, 2007.


today in new bulletin dated on July 15, 2008 shows that TSC is has processed cases till July 16, 2007


the dates can either move forward or stay as it is as per simple logic. But how can they can move it backward?

Smile Notice Date or Recieved Date

I read lot of posts here that say “USCIS is processing as per the Notice date and not received date”.
I know lot of July 2 2007 I-485 filers have different notice dates. My RD is 2 July but my ND is Aug 29 2007. My question is when does my Priority Date (12/2005) kick in?

How is the ND assigned? Do they consider PD before they assign ND?

There may be a case where some July filer who has ND before mine (Aug 29 2007) but their PD could be later than mine (12/2005). Who gets priority here?

Although I strongly believe that it’s all luck.

Gurus:

I have SOFT LUDs on all my Portfolio (of cases 485/ead/ap). 06/06 is a Friday. What does this mean.

Does anybodyelse has this.. Mine 10/05 EB2 I pd. 485 RD 07/02/07 and ND08/30/08 at TSC.

Appreciate info on anybody else's case is like this.

Default Processing times may not be of significance except in some cases

I personally believe that we should not go by the processing times posted by USCIS. It is only useful if your case is outside the processing time and still not processed, we can call USCIS for expediting. If the case is inside the processing times, they wouldn't even respond properly.

In my case, My 485 was filed on Aug 7th 2007. The reciept had a notice date of Sep 17th 2007. I got RFE's on mine, my Wife and son's 485 in April 2008.

Going by this months Processing times at NSC, they should not even have looked at my application.

This is what is think.

The assignement of ND is only dependant to some extent on RD and other part is luck. ND is not at all dependant on PD with in the pile of applications that got current in a visa bulletin. They pick up cases purely based on ND and check to see if the PD on the case is current . If yes they will process it, otherwise drop it back on the pile and pick the next in the order of ND.
