Approved I140 Change of employer in 6 th year- H1B extension
 
Hello,

I have approved I140 from employer A. Employer A applied for H1B extension on 5 th year for 3 more years. It was approved. I am planning on changing job on 6 th year. Can Employer B apply for H1B and get the extension ?

Can employer B apply for H1B even when I140 is revoked by employer A? Please help.

Employer B can file for extension based on the I 140 approval from employer A. But if I 140 is revoked then employer B cannot file extension. The new rule making which is in progress might make it possible once it becomes effective. Best thing is get the approval from employer B and file your resignation. That way you have ur extension in hand
