View Full Version : URGENT Action Item: Final Comments for "EAD for I-140" rule

Dear Friend,

For the past several weeks we have been heads down working hard to draft our official technical comments in response to the "Retention of EB-1, EB-2, and EB-3 Immigrant Workers and Program Improvements Affecting High- Skilled Nonimmigrant Workers" regulation, also popularly known as the EAD for I-140 regulation.

The comments were officially submitted today and the tracking number is 1k0-8o8n-dqez.

We feel proud to have submitted our sincere and honest thoughts on this regulation on behalf of the high skilled immigrant community. To make sure special interest groups supported by large corporations and immigration lawyers do not jeopardize the effort - we have decided to NOT publish the document for public consumption until the comment period ends.

Thanks IV Admin, Hil and all others who have stressed themselves and stretched themselves to provide comments. You are the only ones that can lead us through the finish line.

Most of us are in vulnerable state and are at cross roads waiting for direction. Hope USCIS reviews IVs comments positively.

It would be really wonderful if IV can push through the quagmire and help USCIS draft a better one and send over to OMB.

Thanks Hil and IV for all the Hardwork. Hopefully we will see some changes in FInal rule in favor of us. I am really not sure this administration can be trusted after reading drafting rule they have published. Please let us know if there are actions items planned posting this comment period which can help change things.

I could see some buggers (must be the ones from immigration lawyer community) that has posted under Aman kapoor and Immigration voice. One blaggard even did a copy paste of the comments posted by IV admin like below.

Update from yesterday's meeting at The White House:
We had an open and honest heart to heart discussion for almost an hour and half. There are legal limitations on what we could or could not discuss. As an outcome of this meeting, we are now working on a detailed plan to do our share to make this regulation closer to the current law. This is not going to be easy or simple. But if everyone sticks together and helps us execute the plan, there is a way to fix this. So please stay tuned as we work on the next steps.


I assume that IV leadership will continue negotiations with the USCIS folks even though the comments period ended to get this rule to a better shape for us left in the lurch.
