View Full Version : Adjustment of Status using Advance Parole is a proper means of obtaining Lawful Perma

Please if anyone can help me figure this out

Husband entered with F1, when finished studies he overstayed and has unlawful presence for more than a year.
Now he is elegible to file for GC but because of his unlawful presence he is uneligible for adjustment of status and also unelegible for GC.

Now, the situation is he has advance parole but has not use it, if he goes out of the country and comes back in with advanced parole will this erase his unlawful stay and then be elegible for adjustment of status/

Please, any help or guideness....

You need to get a lawyer ASAP. Any unlawful presence is grounds for a 10-year bar plus deportation.

Adjustment of status refers to the procedure for becoming a lawful permanent resident without having to leave .It should be distinguished from the traditional method of gaining permanent residence

can anyone tell me if an advance parole document can be used for several entries as long as it hasnt expired?
or do i need a new one everytime?
