Hi All,

I want to ask an Age out question for EB3 employment based ,Our GC I-485 was filed in July 2007 for all family that is for me(primary applicant),my wife and my daughter whose
(DOB-March 1997)her date at time of filing I-485 was 10 years,now she is 18 years and having her EAD and Advance parole documents.My question is will she have age out problem when she will be 21 years of age.

Your daughter should be fine given that her I-485 is already filed. I am in the exact same situation, but with priority date of June 2004. See the link below. Thanks

Does CSPA apply even if I-485 is not filed but Labor and I-140 is approved form long time.

You should be fine if you filed I 485. I went through this a couple of years ago (PD Sep 04)

This year also got EAD & AP approved for all of us.

Once the Kids have EAD, Can we get SSN for them. My kids came to US in 2001 when they were 8 months. just got the EAD not they are turning 15. PD is 2005 march EB3. Currently me,spouse and childs have valied EAD and AP. just want to make sure can get SSN and start bank accounts fro them before they are ready to pay international student fee :(

Yes, You can apply for SSN for kids with EAD.
