Have not received an RFE yet. I don't expect they'd start processing our cases this soon.

my mantra : There has to be some reward in refusing to jump the line and re-file the GC under EB2.

From history of past few bulletins, it seems any jump beyond two weeks is a reward for EB3

mrh, thanks for the update, hope you will get through easily since its a regular RFE that everyone expecting before their applications become active for visa number allocation/approval,

Why are you still on GC? Your PD is current for so long. You should have got a green card from your EAD, right?

I am not sure why are you saying that. Right they are processing PD till 1/15/2004. My PD is still 10 days out.

If they think your priority date is within one year of being current they will issue RFE to make your case ready

I have received email from the USCIS for an RFE. Don't know any particulars yet.

I have a question though. I have had career advancement since filing the GC. I was programmer back then and now I am a Sr. Manager and I am having difficulty to create the job description to match the original job. Did anyone come across such a situation?:confused:

I got RFE today and it is in the mail. I am EB3 India and my priority date is in March 2004. I am expecting to receive the RFE notice sometime next week via mail. I have changed the employer in 2009 and did not file AC21 so they may be asking documentation. Also, I may need to go for Medical again as last one was done in 2007.

Thanks. I was still looking for more details from someone who has re-done medical or employment eval. It was quite a long while back so i don't remember what paperwork i needed to prepare for medical etc. Do you know the process?

I received an RFE email. Mostly wont receive the actual rfe since I didn't file for a change of address. My attorney should receive it though. I doubt he will see me before Monday. I was wondering weather the new visa bulletin will be released today or have to wait until Monday for that too.

Lol, our lives without GC is nothing but a looooong wait.

Hello Guys....

I have received RFE Email on June 26th and received the physical letter on july 6th for myself and my wife for EB3 485. RFE is for Medical and EVL....Unfortunately I have missed the priority date by just 1 day as the current priority date in EB3 is June 1st 2004 and mine is Jun 2nd 2004.

At the same time i did my EB3 to EB2 porting 2 years back and finally my PERM Audit got approved and I am about to apply the I-140 in premium.....Any predictions for Sept Bulletin for EB3 ? Shall i wait for next month bulletin or go towards EB2 route? What if they retrogress again to Feb 2004? As per the USCIS latest pending inventory there are at least 3000 cases ahead of me in EB3...also i am not quite sure that the inventory is up-to-date....

Appreciate all your replies...My EB3 PERM is a substitution labor and also my ex-employer revoked my I-140 after the 485 pending more than 180 days...If there is any amount of risk i dont mind waiting for few more months on EB3 route as i already waited 10 Years..

I got physical RFEs. They asked for Medical and Employment verifications.

Now my turn to ask questions.

- I changed the job from my original employer to a consulting company. Been working with them for 2 years. I did not apply for AC21. Again, I am changing the consulting company next week. This is a small consulting co. Do I foresee any problems? What should I submit to USCIS?

- I am no longer working with the Lawyer who filed my GC. Is it better to go back to him and continue or I can deal with it myself?

- Should I file AC21 at this point?

Anything else I should know?

I am in a very similar situation like you. Just talked with my lawyer who had filed my GC process. I moved to other company few years back, did not file AC-21 .

I called them today and found out they don't have my case with them at all :-( and they do not have my file (Paper work ) with them at all. Unfortunately, on G28 they are still listed as my lawyers, they were paid in full 11 years back for the GC process.


To answer your question, if you have confidence on your lawyers, go for them. If they are shitty, you may want to go for new lawyers, heck, at this point, shelling few of hundreds of dollars should't be a question (At least for me, I am not going to miss this boat).

For AC-21 go with what your lawyer says, I talked with my lawyer just few minutes back (old lawyers) if your new position is different, they will want to file it (an might charge you extra fees for that).

Talk with a lawyer, you don't want to take any chances.

For me, I am going to continue with my old lawyers as of now.

For Medical, I am guessing you are July 07 filers, if so, if you have the copies of your 07 medical, you might save some money if you go to the same doctor.

I would be making sure the RFE be answered before end of July. I am hoping we all see the "Said" light now. Its been high time!

I guess, if you can manage to get an EVL from existing employer saying you are a FTE consultant with some skills as mentioned in your original LC, it should be okay. Lawyer's words should be heeded though.

I got pretty much the same request. Per my lawyer my spouse got the weirdest RFE he has seen yet - there was no request for anything - just a cover note!

Any idea on how and where G325 Biometric is to be done? Do we have to initiate G325 Biometric appointment by ourselves or do USCIS /Lawyer schedule it?

Sorry, they requested biographic information sheet and not biometric. The form can be downloaded from uscis website - http://www.uscis.gov/sites/default/files/files/form/g-325a.pdf.

Can someone type the exact wordings in their RFE about the employment verification. I read somewhere that they need an employment verification letter which states that an employer is willing to hire you after your green card at a certain pay grade. Either that or they are asking for Current Employment verification.

Also, G325 is not biometric, it is a biographic information form, very simply asking your where abouts in the past 5 yrs and your current address.


My case, I stopped working for my employer in 2011 and haven't worked for anybody since then. Started a business with my wife in 2007 since she got her EAD. Kept working for my employer until 2011. So, if they ask for continuous employment then I am pretty much screwed.

Anybody has any suggestions, please let me know.

Originally planning to respond myself. The forms are pretty easy - Medical and Bio are self explanatory. The EVL letter is pretty straight forward as well.
Since my Lawyer received the original RFE, he just asked me to forward all of the documentation to him.

You dont need a lawyer for usual RFE stuff that people are getting.

that would be definitely something for my lawyer to do. It should be covered under my original filing fee $4800, so he shouldn't ask for more but even if he does, it would be completely worth to pay since the case is so old.

I think an additional $1200-$1500 should do it

It is most likely EVL. In general, they do not need your EAD.

Can someone who actually got the physical rfe, type the contents of the rfe here word to word so we can discuss here what exactly do they need and how to provide it. Different people are saying different things about EVL. Are they verifying the current employment or trying to figure out if we have job availability after the green card.

Any one who has received physical Rfe please type it up here. I would really appreciate it.

I am pretty sure lot of people's EADs will expire around the end of August or September. My EAD expires at the end of September. Should I send it in for renewal just wait to see what happens until the next month.

But here is the main content of the letter: Nothing much to worry! Relax.

1. Current employment letter:a) On Company letterhead - current position, duties, title, dates, salary and wage signed by the authorized person.
b) If changed employer, submit evidence to show you remain eligible to adjust through visa portability under section 204(j) of INA. Its basically same above letter supporting original I-140 position.

Ok, I can get an employment letter from the same company that actually hired me. I worked for them until 2011 but then I quit to help my wife with her own business. I didn't file any ac21. I can get a letter from them that they are willing to hire me at my previous wage after I get my green card or whenever I want. Do you think that will suffice?

I can also ask them to give me pay stubs since last few months showing I am still working for them with the same duties etc.

My priority date is Nov9 2004-EB3-India. Staying in this county since 2000. Since now there is some light at the end of tunnel want to ensure I am ready with the documents once situation comes up.
Here is my question:
A) I changed employer on Jan21 2008 on EAD and the position was same as was filed for my labor.
B)In May 2009(-till date) I changed employer.My title and job responsibilities changed. I am talking to employer to give me EVL which matches my original job requirement.
Do we know how much % the existing job should match original one?
There is around 50K diffference(more) in my salary from the one in petition-Will this cause any issue?

From what i have gathered on the net, USCIS will be "rational" in their decision making and will look up several factors to make their decision on "same or similar"

1. Job Title is the least of their concerns as this may be different. (e.g. program Director and Project Manager may be similar roles)
2. Description of Job duties needs to be similar roles and responsibilities and within the same Field. (e.g. IT to IT).
3. Salary needs to be within range. I would consider 50K different to be out of range and a red flag if your roles and responsibilities are not very similar (Yes i know its draconian laws that don't allow people to earn more but they consider this as being a truly big change in jobs.

You can google it Higher salary is never a problem. Make sure your role and responsibilities match. it has been around 8 years it is reasonable to make more money.

Has anybody seen any issue with salary increase while status adjustment ? Is there any written law from USCIS to decide whether your salary is in a particular range compared to when GC was filed ? I dont think so because I brought up these points when I wanted to file for EB2 about 5 yrs back with my employer who is a big corp and lawyer there said that you can be VP of your department and we are still not required to file for EB2 as my 485 was filed and it gives enough flexibility to work on whatever position you want BUT in same field.

If there is so much flexibility then how can pay not go up by 50K or 100K , I mean if I am a VP then obviously I cant be making same as when I filed my GC. Also, if VPs are hired at 2004 salary + 50K of a programmer/analyst or whatever entry level position for IT is then I would think everybody would be lining up to hire us. We can add couple millions in profit right on the very first day :) :) :)

EB3 India. PD April 2004

When i-485 was applied my wife had her maiden name (Before marriage). In 2009 when passport was renewed, her last name got changed.

AP & EAD have the changed names that were renewed twice.

On the medical REF they have her maiden name.

I am not sure in what name should doctors give the medical form.

Any guidance is appreciated.

It happened to Me too, I just responded to my Medical RFE, (2 June 2015) and as soon as the Service center received the document, there was a status change in my case indicating, Card production. A week later the case status changed to Document review. THe status now shows:
Response To USCIS' Request For Evidence Was Received
On June 2, 2015, we received your response to our Request for Evidence for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number **********. Our Texas Service Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. Do the employment letter need to state the minimum educational requirement for the Job?
My employer is not willing to provide the Minimum education needed in the employment letter.

In general, I am not sure how a Consulting company can state the job is "permanent".
The consulting company pay depends on the client. They cannot pay anything on their own. Its a consulting business.

So need more insight on this one.

I received the "new card production ordered" email today for both myself and wife after RFE documentation submission. If anyone is curious on time frame :

received RFE letter 7/9 from USCIS
Responded 8/3 (package received by USCIS on Monday morning)
Received 8/3 10 PM - confirmation that RFE docs received and case is back in processing
Received 8/5 6:30 PM - Card production ordered email.

I hope that this really is my GC and not a glitch which some users have reported where its gone back to Case review after a few days!

2. My lawyer responded but I saw his note - he didn't respond with anything special at all - just cover note with Subject, here is the list of documents per your RFE request blah blah, that's all
3. No copy of any paycheck etc. My employer is a Global brand, so no issues with ability to pay etc.
4. The most important aspect in my opinion was my EVL letter. Since i had changed jobs multiple times, and frankly the original sponsorship job didn't match my current designation or role very closely from the description, I had to have that crafted and send it to my HR to have it approved. They did so with the approval of my manager and lots of red tape. They were unwilling to change my title either (which if you are aware in big companies, have bizarre names that don't match your business card (e.g. Outside Specialist III instead of Business Dev manager etc.)
5. Also I never filed AC21 and in my lawyer's response there was no mention of me invoking AC21 or any such thing. We just assumed officer will take note based on my application.

Yes thank you. Its been a long and painful road. I haven't had the benefit of luck, timing or foresight to change my application to EB2 etc or jump the queue in any way. Just waited it out patiently. Most of my friends are Citizens already. Anyway no reason to whine today - i have to take the positive - I have been Greened! :)

I picked the template off the web using google. I don't have the text anymore because i changed it for my own EVL and i only have scanned copy which i do not wish to distribute. I will look for the link and post it here.

I did not change my lawyer. He happened to be my original company sponsoring Lawyer who i retained on a personal level after i quit them.

I don't know what he charges as he hasn't billed me yet.

Just got the notification that my i-485 application is approved! Looks like approvals are going out based on August bulletin from NSC.

Some details:
PD: March' 2004
I-485 application filed: 07/02/2007
RFE date: 04/29/2015
RFE replied: 06/02/2015
I-485 Approval: 08/07/2015

Awesome! Congrats! Now we wait to see if the welcome letter has us going to local office for photos/fingerprinting again (my status changed from Card production ordered to welcome letter ADIT processing blurb)

check your original Application for employment certification doc (if you dont have it ask your lawyer). It will have a fairly detailed description of your duties, roles and responsibilities. You will need to extract that for your new EVL. You can then use the above template as a guideline.

Thanks. Even in my case it changed from card production to Welcome letter and all the details. I think it is a general notice and card should arrive in a week or two. Just have to wait and see.

According to Sept 2015 visa bulletin, the EB3 has moved to 22 Dec 04, Our priority date is 2 Aug 2004, we have already completed our Medical and employment verification RFE's and submitted em in July 15,
What can we expect now that we are current. Appreciate any response! Srividhya and Bala

Our Lawyer is asking to provide W2's since I-485 filing date, 3 paystubs in addition to EAD's, written explanation for changing the job, I-797 receipt notices for I-485, I-140, medicals etc. Anyone has similar experience with Lawyers? Appreciated in advance for sharing.

EB3 India, PD: July 13 2004, RFE received on July 13, 2015 for primary and 2 dependents, not received yet for 1 dependent.

The RFEs being delivered are straight forward for EB3 2004 cases - EVL, Continuous employment (EAD copies) and Medical. Your Lawyers seem to be going way overboard, unless there is something additional being requested in your RFE. Check the letter first and then you can question them on why they are asking for all this information. Seems a bit unusual.

Thank you. I think he may be asking W2's, paystubs as "primary" has a gap of 43 days in last two EADs due to USCIS delay. We have RFE copy and it does not state anything about these documents. So do your W2s reflect No pay for the gaps? i.e. you should have been off employment during the time that EADs were expired/GAP. I guess the Lawyers are being thorough to make sure you don't get red flagged.

I don't think anyone can make out the gap from W2s. The copies of EADs will clearly indicate that. Salaries always vary year by year with increase or decrease. (not less than shown in Labor). We had all the W2s so did not mind. We asked the lawyer about the gap in EAD and he confirmed that it will not be an issue. At the most, there will be another RFE and explaining response will resolve it. Keeping fingers crossed and hoping for the best.

Don't know what to do with RFE not received for one dependent. Can I call USCIS or just wait? Thank you in advance for sharing.

My lawyer is thinking of proactively sending the the letter explaining that current job is similar to the one for which EB3 case was applied for. I am with the same company, same job/dept but higher title...no change in the responsibilities.

I don't think we should send any thing else if it is not asked for.

Do you think it is a good idea to proactively send the letter?

I would call USCIS for the dependent case (but that's just my opinion). Its unusual since they require at the very least the medical redone by law as it expires every year (CDC memo). If you wait, you may get the one dependent case running out of sync with your applications. My wife's RFE came with no requirements at all (seemed unusual) so we responded with G325a and Medical for her anyway and they approved it.

I don't think that they are approving any cases without sending medical rfe's unless the medical was done in last 365 days. Unless there is a glitch or someone is making a mistake somewhere, a Rfe is inevitable

If they didn't ask for the letter, they might just disregard it. Sending it anyways doesn't seem to harm your case. You are one of very few people who is still working with the same employers. Your case is very simple. Relax and let him send the letter.

Any one got approvals for their 485 applications for PD from Mar - Sep 2004 EB3 India? Any idea how long it takes once the date is current? My PD is april 2004. Got RFE to provider medicals and EV. Responded to RFE with all required documents and uscis received it on July 15th 2015. So far no update on my status. It would be very helpful if you share your approval status with PD.

My PD was march'2004 and it became current as of Aug'01. My application was approved on Aug'7th. So, urs should be approved anytime now. Good Luck!

I was facing a similar conundrum since i am in a sales role and base+commissions can make your total compensation out of wack after 11 years!. Luckily for me, my employer only mentioned my Base pay on my EVL which was totally in line with my original Labor.
Others have posted that its quite normal to have a major change in pay since its over 10 years since labor has been filed, and we should not worry. In any case, I don't believe we end up having a choice and have to submit exactly what HR wants to.

1. ALL EAD copies since filing I-485 - YES to prove continuous employment. Unless you want to submit other documents as evidence per your RFE letter. EADs are the easiest method.
2. Perhaps. Submit all copies and don't highlight it. Wait to see if they ask anything. They may not.
3. No Idea about this one.

It should be other way around. We should NOT work, when we don't have a valid EAD "in hand". I continued to work instead of stopping the work. Because, its not possible to discuss with the employers. They don't care.

That aside, to cover that up, there is a clause. I don't recall the number, which protects this type of work.

If they specifically ask for proof of continuous employment, you might need to send all the copies of EADs. But if they did not ask for it, don't send it. Thats the advise I got

Later in 2011 she created an s-corp for tax purposes and continued working as an independent contractor. How do we fill the experience in the last 5 years section for her? What would be the name and address of the employer in this case?

So If you are the primary applicant who's employment based GC was sponsored with a Labor certification, it doesn't matter what you put on your Spouses Work experience / employer as they will be least concerned with that and She was essentially allowed to do whatever she wanted on her EAD (this is my opinion btw!). I would put something like "Self Employed / Independent Contractor" on employer name.

Hoping to send my response on by Monday.

On the other hand, we got an email for my wife's rfe, but nothing arrived in the mail. Mine was delayed too, but she never got hers. We tried to call after the 30days of the notice and they made a case and gave us a case number. Now her case updates says

As of August 10, 2015, your inquiry about a Request For Evidence that you did not receive, referral number T1DXXXXXXXXTSC, is currently not assigned for processing.

Now they are asking her to wait for another 30days from august 10th. This is ridiculous. I don't know how some people talked to people in USCIS who were so courteous who faxed the copy of the rfe.

Each rep is different.. in their level of knowledge, patience, and being really helpful..

Got RFE on March 25th 2015, for Medical and Employment verification, replied on June 7th and USCIS Response of the receipt of the medical doc on 9th June 2015.
Nothing after that. Hopefully soon.

My wild guess is, they "might" move back the dates for two or three months in the next bulletin. From demand data, I don't understand the logic of moving the dates until Dec.

Well, personally I wish the dates move ahead and everyone gets the GC regardless of how late their PD is, when they are current. But practically, I am cynical about it.

Please check the address on your I-485 receipt. RFEs are sent to that address unless you filed the address change form. It happened in my case. RFE was sent to my ex-employer address and I filed the address change form and I received the copy in couple of weeks.

Congratulations. You must be having one hell of weekend :D . 16 days from the day your attorneys response, not bad at all. I have everything ready and hopefully my attorney will send it on Tuesday. I just have one problem, I lost my first EAD that was issued in 2007. I will send the approval notice and a letter saying I lost it. Hopefully they will understand.

I am also an August approval case.

August 5th - I received this notice - "we registered your Permanent residence status and mailed you a Welcome Notice".
August 22 - received "card production ordered" email.

I always maintained legal status including extension of AP and EAD on time with no lapses. My current job is similar to the original position described in the approved i-140. The issue is I had to change jobs couple of times in the past 5 years, including short term contract positions and periods of unemployment ranging from 2-8 months. I never filed for Ac21 for any of the new jobs (I was told this is optional). I am wondering how the job history will impact the green card approval?

Any advise/ suggestions on this would be appreciated.

Changing job is not an issue. Nothing to worry.
When replying your rfe, the letter should be from intended permanent employer.

I got RFE in June and by July 14th submitted response. My PD is April 14 2004.

Filed my I-485 in July 2007 and medicals were done at that time.
Changed employer in July 2008 and did not send any AC-21 letter to USCIS.

"On August 25, 2015, we registered your permanent resident status and mailed you a Welcome Notice for Receipt Number WAC1234567890. Please follow the instructions in the notice. Your new permanent resident card should arrive by October 24, 2015, after this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. "

I guess this is it!

So all the gap was between "new card production ordered" email and "card shipped" email. Probably takes them time to produce the actual card. Once i got the card shipped email on last Saturday, card arrived this morning (Tuesday).
They sent it US mail Priority.

AILA reports that the card processing facility for green card and EAD has been undergoing maintenance services and these cards have been transferred and produced by another facility in another location. For the reasons, the USCIS has been experiencing delays in production and mailing of the cards for about two weeks after the approval notices have been mailed. In sometiime September, reportedly the situation will change to a normal processing time.

Check you case status online. That can give you some clue if there was an RFE issued or not !

Have you sent updated G-28 form to remove the old lawyer from your file? The companies' lawyer will continue to represent you unless you file G-28 to remove your old lawyer. I learnt that your past employer can ask that lawyer to even send the notice to USCIS to withdraw your application and your application will be considered withdrawn because that lawyer also represents you per your representation form G-28.

I am in the same shoe. I removed the name of the past employer's lawyer and put my own name with contact information on G-28. Now any RFE/notice will comes to me instead of going to the lawyer of my past employer (who is not expected to forward me anything).

Thanks for the information. My prevoius lawyer had sent a letter to USCIS citing they are no longer representing the case and updated my address I belive. I do not have any new lawyer now.

I believe you should invariably get an RFE for EB3 cases to re-submit your new Medical records and Continuous employment. The medical records are valid only for a year or so and given the wait time in EB3, you can expect that they will expire.

The RFE for most people usually comes around the same time as the Visa Bulletin that suggests that your PD will be current in coming month.

If you get an RFE, it is a good news. That means they have started looking into your I-485 case for approval. Make sure you subscribe to text messages from USCIS website - helps you stay on top.

Recently checked statusat USCIS Case Status website, and learnt there was an effort to deliver an USCIS notice by USPS, but they were unable to (not sure why.) Previously received RFE second week of July delivered by USPS at residence, wonder why they weren't able to deliver it this time. Also, we haven't responded to the RFE yet, and reportedly are in receipt of this second notice, doesn't say what kind of notice though.

Has anyone received a second notice following an initial RFE? What was the second notice about?

Also, created an SR by going to www.uscis.gov/e-request and it said to expect a response by 9/22. Has anyone called USCIS customer service, where does one get the tel. no. from?

Your initial rfe notice they will send it to your lawyer also. If your lawyer address on file also changed then they will update primary applicant status as mentioned by you. Respond to initial rfe. Once they receive your rfe, they will change your status again.

I got a notice today Aug 24 for me and my wife :

I got RFE in June and by July 14th submitted response. My PD is April 14 2004.

I got my physical card today Sep 2nd.

On August 27, 2015, we registered your permanent resident status and mailed you a Welcome Notice for Receipt Number SRC########. Please follow the instructions in the notice.

Your new permanent resident card should arrive by October 26, 2015, after this registration or after you complete any ADIT processing referred to in the welcome notice,

whichever is later.
