View Full Version : H1B 6 years stay ending , I-797,I-94 still valid for another 11 months

Hi ,

My labor with priority date 4/16/2013 got denied , my 6 years H1 (including L1) completing on Nov 5 ,2014 , however I got I-797 , I-94 and visa stamp in passport till Oct 28,2015 .My Attorney suggesting to appeal PERM and request one more year extension Nov 2014 - Nov 2015.

1) When I already have visa stamp and I-797 till Oct 28,2015 , do we really need to apply for new H1B extension for Nov 2014 - Nov 2015 ?
2) Assume if I am not getting H1B extension from Nov 2014 - Nov 2015 , can I stay with my existing H1B stamping till Oct , 2015 ?

Can you clarify my doubts ?

Can you please post updates here on what you did and how long you stayed? So other ppl have similar situation can also get some idea. Did you follow latest dates on I-94 and 797?

Hi Amit,

As per attorney's suggestion we applied for H1B extension and I got for 1 yr based on Pending perm , though my I-797/I-94 including visa stamp in passport is till 10/2015 .
