View Full Version : Stay extension because of Medical condition

Hi All,

Yesterday my dad got heart attack and Doctors did his angioplasty in emergency and doctors saying my father need at least 1 month rest before travel.

My parents are with me about 6 months and they were leaving on 3rd of November and their 6 month stay is ending up on 8th of November. So because of medical condition i need to apply their stay extension (mind you they have valid visa till end of next year).

Please tell me
1- what is its process
2- which form i need to fill to apply
3- can i apply online
4- what is the fee

Hi

sorry to hear about this. You better go to local USCIS office and check with them. they can temporarily extend the I-94. Take all medical records with you.

Nice, thanks. I've taken an appointment.

The USCIS website also states an option to file I-539 online. Frequently Asked Questions e-filing the Form I-539 using USCIS ELIS | USCIS (http://www.uscis.gov/uscis-elis/faqs/i-539/frequently-asked-questions-e-filing-form-i-539-using-uscis-elis).

But not sure how the processing times are on that.

I'm a little concerned that the USCIS guys might redirect me to that application when I show up for my info pass appointment. Could this be the case? Has any one recently had personal success or heard stories of successful I94 extensions for people on Visitor Visa with a valid medical reason?
