Is EB3 india movement related to the porting to EB2?

From the visa bulletin -
The Employment-based Third preference cut-off date for most countries was advanced at an extremely rapid pace in April through July in an effort to generate demand. Historically such movements have resulted in a dramatic increase in applicant demand for numbers within a few months. At this time there is no indication that the expected increase is materializing or will do so in the near future. This has resulted in significant movements in the September cut-off for all countries.

It is unlikely that there will be any forward movement of most Employment-based cut-off dates during the next couple of months. In addition, a sudden surge in demand could require the retrogression of a cut-off date at any time. Such action would be required if it appears that such number use could impact visa availability under the FY-2014 annual limits.

Most of the categories will retrogress in OCT Bulletin. Hopefully EB3I will stay around JUNE 2003.

Looks like might take few more months for folks like me.... as it is mentioned "It is unlikely that there will be any forward movement of most Employment-based cut-off dates during the next couple of months." in VB. Still a welcome move for long time waiters... Though this is very good.....

Most idiotic planning by USCIS/DHS for EB3I. They did not move at all last month and they predicted it to be up to 3 weeks and this month 8 months movement.

It has been a while I followed the process timings. Do we need to get finger prints done again? If so, will USCIS send us notices? What is the current trend of processing times after date is current?

FIFO officially but some will be screwed. Like we my friend with the same PD who filed after 10 days of mine got it in two months in 2007 from TSC.

Congratulations to all EBI who became current...

Here are couple of advices

1. Please don't go crazy & flood USCIS with requests from Sep 1st, this will only get things worst (this is very common advise from many of IV core members, just in case you missed it)

2. Reality is there are around 6200 applicants(accourding to jul 2013 I485 inventory) from Feb - Sep 2003, it is nearly impossible to approve these many applications in a month, don't set your expectations very high.

Good thing. But I'm sure this will retrogess. It will be more painful for those who were current and then the dates retrogess. Best of luck to all who are current. If this trend holds on, I'm just two months away. Maybe I will be lucky too.

They sent it for my son who turned 14 this June but not for me and my wife. Son's FP is scheduled for end of this month.

Can I walk in before that?

Just curious, why to open a SR when your's is current? Mine is Jan 29 2003. Pending 485 approval. Do I need to do something on Sept 1st or I just wait for my GC in the mail?:confused:

If you filed Eb3 in 2004 its going to be 10 years soon, dont waste precious time. Washington doesn't care, but you can make it happen.

Good thought but did anybody notice China's dates. Their EB3 is now ahead of EB2. Once EB2 india catches up with China then the spillover will have to be evenly split. I guess China might actually become current all categories by next July. Next couple of months will surely be interesting.

Try not to have high hopes. The dates will retrogress for sure in OCT bulletin. If you don't get it in September you may have to wait another 6 months to a year.

I know the feeling. My date is Oct 23, 2003, so was spared going all out crazy, but still unbelievable, that the dates are so close now. I hope I can finally party soon as wll.

This is the part where you are supposed to smile, laugh, drink and enjoy. If it does not materialize, so what. You at least got current for 1 month which so many others in EB3I can only dream about!

Dude, for god's sake DONT say that....damn man!!! Mine is Eb3 July 2004. I am excited to see this historical movement in Eb3, in this bulletin and hoping this will continue.

1. Does this mean in EB2/EB3 India will get their GC who are current considering that they already filed their 485 and so far they didn't get any RFE ?

2. Is it 100% chances to get GC? or out of all some may get and some may not.

3. Do we need to give fingerprint again? My PD will current from next month. I read somewhere that fingerprints valid only for 15 months. For me it already 16 months passed when I given. The dates will be remain current for a month and if we need to give again what are the chances to get GC?

I agree with you.

Did you know that you can always file your I485 in lower category? It is not really porting of priority date. You can always use EB2 I140 to file EB3 I485. You should be able to do that even if you have already filed for I485 in EB2.

If I remember this correctly - I had done my Medical and Finger Printing in 2007 when they had one month current in 2007. I'm India EB3 June 2003 case.

My Question is - Do I need to do Medical and Finger Printing again ?

** I am just praying that this is not like the 2007 Current and retrogress to life time lease around our necks again.

Porting is only one of the reason not the only reason. If porting was the reason why significant forward advancement only in September? It could have been earlier too if it was the reason.

I would say that there is not much porting, isn't that the reason Sept VB was delayed since USCIS wanted to see the rate of porting and thats the reason they advanced the dates to June 08 for EB2I..

You are 100% right, the fact that there is HUGE movement for EB3-I in September or for that matter all EB3 categories, seems they messed up again and DOS is afraid to waste some VISA numbers again this year. Good news is that they still have about 45 days left in this year.

Another mystery is why no movement for EB3-I in August at all and now sudden move of 8 months. Seems like DOS is shooting in the dark again ..

I think DOS is trying to maximize Visa numbers utilization and they have opened the window wide open, just for that reason, just like what they did in July 2007, albiet on a much smaller scale.

Happy to see movement in India EB3 movement to sep 2003.

My PD is May 2004 .
Hope fully there may another big jump in October.
can any one update me How long its take to have actual green Card in hand after one's date become current. And secondly what is the process. is there possibility of getting GC in mail directly at home address or one will go through RFE and Interview.
Please any one recently greened update me and others viewers on this forum.

Please be realistic. This time the dates have moved because EB 3 ROW spill over to EB 3 India.That may not happen in future.Yes time to get GC has shortened by 3 years.As 2003cases might be cleared till September 2003
Porting will increase the movement of dates to 3 weeks.

Based on the published demand on 07/17/2013 - The number of pending India EB3 i485 open cases between 01/2003 thru 09/2003 is approximately 68xx cases. I want to be truely optimistic - but, then seeing how slow USCIS is at processing - can they really process 6800 EB3 India + all the other moved dates in one month - I just can't see them doing it practically (unless they only focus on the countries that are really backlogged).

I hope they have a ton of preadjudicated i-485, that just need to order card productions ;). Praying like crazy.

Experts my 2 cents (may be wrong).. Lot of EB3-I to EB2-I ported I-140 were already approved last year. As soon as last EB2-I moved to 2008, they filed I-485 and caused EB3-I date movement.

Spillover will only be possible if EB3 ROW is current

The date movement is Bcoz of EB3-ROW as they dont have so many ready to approve next month. It does not have to be current.

Porting was happening from 2007.

The spill over from eb3 ROW may happen again in few years. This year the dates for eb3 ROW will move at a faster rate and may be Current at some point.

The list of documents I know of so far are as follows. please assist with updating as you see fit. should the fingerprinting fee also be enclosed as a sperate check for $90? :

Form I-485 and Supporting Documents (Application for Adjustment of Status):
1. Payments of $1070 in personal check made payable to U.S. Department of Homeland Security.
2. Form I-485, signed and dated by dependent.
3. I-693 and immunization records in sealed envelope from Civil Surgeon.
4. G-325A form.
5. 2 Passport Size Photos with name printed at the back of dependent.
6. Copy of dependents Birth Certificate.
7. Copy of my dependents Passport current and old, H4/F1 Visa Page, and Form I-94.
8. Copy of my primary applicants I-140 approval notice and I-485 filing receipt notice.
9. Copy of Marriage Certificate.
10. Copy of primary applicants Passport current and old, H1-B Visa Page, and Form I-94.

I hope the following predictions turn into reality & all the forward movements in September will only progress forward in FY 2014 for All the categories.
September 2013 Visa Bulletin Analysis:

EB3 India: The second biggest movement was EB3 India. Dates moved forward by 8 months. This could be due to (1) receiving spillovers from EB3 ROW (which has very low demand) and (b) reduction in demand due to people porting to EB2 India

October 2013 visa bulletin is start of new fiscal year 2014. All visa spillovers would be used by Sept 30 and quota would reset on Oct 1.

F2A (all countries): F2A category is also expected to retrogress in Oct VB. The actual retrogression date depends on two factors: (1) how many cases were received and processed by USCIS by Sept 30 (2) how many cases are pending with older PD. If there are lots of cases which have older PD still pending on Oct 1, F2A could retrogress further (Apr 2012 to July 2012).

EB2 India, EB3 India and EB3 Philippines: Movements in these categories depends on how many visas were consumed by Sept 30. If USCIS does not allot all spillovers by Sept 30, dates for these categories could retrogress in Oct VB (since there will be more cases pending than expected).

EB3 ROW/Mexico/China: There is a high probability that dates could retrogress in Nov/Dec VB. The actual cutoff date in Nov/Dec VB would depend on how many applications were received by Oct 10 (Nov VB would typically be released around Oct 10).

EB2 India movement depends on which of the three options Charles Oppenheim is comfortable with. If his estimates are not correct, EB2 India could become unavailable in 2014. Please see article

I was specifically wondering if the correct way to open account on uscis is CASE STATUS UPDATE LINK on left side of page or is it on right side of page link called sign up for ELIS SERVICES........IF ANYBODY CAN HELP?
I read a term called LUD a lot what is that?

Yeah You can. You can ask the L1 officer if you care has been preadjudicated. At that point of time he will forward you to L2 officer. Now if you are unlucky then you may come across a L2 officer who is rude then you will have to try all over again by contacting the L1 officer again.

2nd option: Take infopass and then you can find out.

My priority date is current as of Sept Visa bulletin, do I need to open a service request to process my application? Could some one post the contact details to talk to the customer service agent?

It means, that USCIS has done all checks,and verification on your application.They are waiting for the availability of green card
