View Full Version : Divorce immediately after GC

A sponsors B for GC as a dependent in employment based category. Marriage is not healthy. A and B knows this. B is fully dependent on A for the GC status. B wants to file divorce after the GC gets approved. GC gets approved, say in 4 months.
Can B's GC be at risk for any reason if divorce is filed after GC approval, if A wants to withdraw for some reason, say B doesnt deserve it due to circumstances

When A knows marriage is not healthy and still sponsors the GC why should A backstab later? If A is the man, he is not a real man ! But B knows best if A is honorable or not

If relationship is not healthy why should you continue to sponsor. Send a letter to USCIS to withdraw dependent application. Set your spouse free to make choices in life. Do not make one yourself by giving a path in USA. Maybe USA is not best for the souse.

You're assuming the Original Poster is the GC applicant/holder, when they might be the dependent.

Notwithstanding the morality of the situation, on a technical/legal basis, yes, i believe that they do check up on you to make sure you're still married. The GC they give you based on marriage is a conditional green card for two years - which in your case will be revoked if you're not still married.

I do think though that if you can show you got married in 'good faith' you may be able to remove the conditions when they ask later on.
