View Full Version : EB2 in case where FLC Job Description does not have Masters

I have the misfortune of working with a company that has not yet done a GC application, and I think the company lawyer does not have a clue about this process. I am sure some of you would be more knowledgeable than him ;).

Depending upon how I describe my job it can classified under one of the following: Computer Programmers (http://www.onetonline.org/link/summary/15-1131.00), Web Developers (http://www.onetonline.org/link/summary/15-1134.00) or Software Developers, Applications (http://www.onetonline.org/link/summary/15-1132.00).

The lawyer tells me that since I have a masters degree, he would like to try for EB2. However due to his analysis of the “prevailing wage”, he thinks he can only apply for Computer Programmers (http://www.onetonline.org/link/summary/15-1131.00) or Web Developers (http://www.onetonline.org/link/summary/15-1134.00).

My question:

In the FLC Job description for Computer Programmers (http://www.onetonline.org/link/summary/15-1131.00) and Web Developers (http://www.onetonline.org/link/summary/15-1134.00), there is no mention of a qualification of Master’s degree. Do you think I can still apply for EB2? (Software Developers, Applications (http://www.onetonline.org/link/summary/15-1132.00) does have a Master's Degree as a option, but the lawyer says the wage is too high.)

Besides a masters degree I had 2 years experience before I joined this company and I have been here for about 3 years.

As a side question: Is there any way to get prevailing wage through a website esp. Level I, II etc? I am asking particularly for my state/location, not the median value for all of the US.
