View Full Version : Use of prior Priority Date with current emp after 140 approval with previous emp

Hi,
I have a GC priority date of May 2010 and i got my I-140 approved with my previous employer. I then became full time with my client in Aug 2011. They haven't yet started my Labor filing. Few months ago my previous employer told me that he has dropped my I-140 sponsorship as it costs him money to keep it going. The Immigration Specialist with my current employer told me that as long as i have a copy of my previous I-140 I can use that previous priority date for my current filing.
The new Immigration Specialist does not know much of the rules and is mostly hesitant to provide me information.
Can anyone let me know whether I can still use the old priority date with my new Labor filing, I140 and so on?

Yes, you can maintain the same priority date for all future employments.

If you I-140 was already pending with previous employer, why did they drop your petition? Unless they receive query pending I-140 cost no money if they continue to wait for an application already filed.
