View Full Version : Verify EB2 I-140 interfiling with pending I-485 successful

EB3 priority date is March 2005 with pending I-485 filed in 2007.

After EB2 Perm approval, EB2 I-140 was filed with an interfiling request to port the EB3 priority date and also to link the pending I-485 with the new EB2 I-140.

In Oct 2012, EB2 I-140 was approved and I-140 interfiling request successful (I-140 shows older priority date).

I was expecting a LUD change on my pending I-485 to indicate that it has been linked to the newer EB2 I-140. It's been three months and I haven't seen any updates.

Is there a way to verify that my pending I-485 has been updated with the new EB2 I-140.

Call USCIS customer and try to reach an officer (The Customer Service Representatives are good for nothing just reading from USCIS website).

also I have a question for you, if interfiling request succeeds, do you still have to file a new I485 or the previous one itself suffices ?

Thanks bsbawa10 for the response. I will do that.

As far as I know, a beneficiary can have only one I-485 application. So the pending I-485 should suffice. After successful interfiling, when dates become current it should be picked up for processing.

Anyone with more expertise, please correct me if I am wrong.

IF you already have 485 filed then you do not need to file new 485. During the porting process the existing pending 485 is linked to ones new I-140.
If you need to confirm that your 485 has been linked you can just send an email to USCIS with receipt numbers (I-140 & I-485).
I sent an email to ncscfollowup.nsc@dhs.gov since my 485 was filed at Nebraska and had received the following response.

All petitions and applications must be connected to your Alien file before adjudication of your I-485 can begin. This process has been completed. USCIS records indicate your applications are pending the availability of an employment based Visa. You are 2nd preference from India with a priority date of September 30, 2003. Currently there are no Visas available for this preference. Your applications will be processed when a Visa based on your classification becomes available. You are invited to visit the Department of State website, Welcome to Travel.State.Gov (http://www.travel.state.gov), where you can view a current bulletin regarding Employment Based Visas.

Can I reach out to USCIS about interfiling status as soon as I have the new I-140 receipt number or should I wait until the I-140 is approved?

My company has filed a new I-140 and have requested to link to an existing pending I-485. The issue is they have not filed the I-140 as premium. Does this mean uscis will review my I-485 only are my new I-140 is approved? Any help is much appreciated

At the time of filing I-140 your attorney must have attached a copy of your I-485 receipt notice. Soon your I-140 is approved and older priority date is captured, USCIS system will automatically indicate a current date on I-485. At that time if USCIS does not have an interfiling letter, they will seek clarification sending an RFE. So its a good to hold until the I-140 is approved to see if the old date is retained.
