Currently I am on EAD. My I-485 application is pending.

I have applied for a PIO card for my daughter with Travisa outsourcing. They have held the application and have asked me to send another USA Visa status (for parents) for proceeding with the application. They say Indian Consulate has advised them that EAD is not a valid Visa Status any more. This applies to both PIO card and Indian Visa.

Need help on how to proceed with this situation.

Why are you using outsourcing company when you can apply directly to the consulate?

It is like the VFS service.

Embassy/Consulate does not handle Visa/PIO services any more.

EAD is not a status but only work permit. I-485/Adjustment of Status is your immigration status. When I did mine for my son, I sent my 485 and also the EAD to demonstrate that I have a work permit.

12.Visa Status of Both Parents:
If any or both parents are non-US citizens, then each parent must provide a copy of one of the following: your Permanent Resident Card (both sides), Employment authorization card or copy of page showing H1 / H4, L1/L2, F1/F2, J1/J2 etc. visa. It is essential that Indian passport holders who are applying for their child's PIO card must provide their visa status proof. If you have applied for visa extension, then proof that the extension has already been granted should be provided

Attach yours & your spouse's ATTESTED Copy of Birth Certificates, Copy of SSC, HSC Marksheets, Copy of Driver License, Copy of EAD, Copy of Employment Verification Letter, Copy of I-140 Approval, Copy of I-485 Receipts (every item for both parents) etc. You should be OK.

Don't keep talking to them on requirements...

Thank you Pappu, Insbaby, Cool_desi_gc !!!

Your replies have really helped me. In fact I just mailed them I-485 receipt Notice, EAD (both parents) and my Employment authorization card.

Just last week I renewed my drivers license using the EAD (card). So was in an impression that EAD is my current residency status.

I sent the employment verification letter and not the underlined card in above post.

I spoke to another rep in travisa today to inform them about the mail that I sent. The Representative asked me to Fax the I-485 receipt notices (my wife's & mine). In couple of hours I got an email that all documents are matched & the application will be sent to Indian Consulate for processing.

My application was sent to Embassy but it was rejected for the Visa Status issue . I just got off the phone with a supervisor in Travisa, she said Embassy needs Parole Document for the application to proceed. Have applied for AP and waiting for it. Have told the Travisa folks to hold my application and that I will send copy of my AP as soon as I receive it.

This does not make sense..
